The fact is that the concept of DIYA or blood money is accepted as per Sharia. The Americans used that loophole to spring Davis and nobody could object. What a ridiculous situation! That too when the Jamait ul Is1am had offered a Rs 1lakh inducement to the families of the dead not to accept blood money from the Americans! I guess $1 million is definitely more attractive than 1lakh Pakistani rupees!

First of all, there is no death penalty for a murderer in India or the West unless it is the rarest of the rare cases!! So, your comparision is absolutely absurd!! Death penalty is not given for each and every murder!!!

In a democratic system, there are checks & balances and media hue & cry will not allow a murderer to be pardoned. Further, like any other executive action, courts can examine the pardon to check whether judicious application of mind was applied while granting pardon. But blood money is a contract between two persons without any role for the court. It's like saying that a rapist/murderer should not be trialed as he paid money to the victim or its family. Personal contracts for such brutal offences can not have any role in a law abiding society as it's prone to abuse, malpractices, external pressure, subjective assessment of value of life, etc.
