sc/st order from supreme courrt
by ramesh kumar on Apr 10, 2018 02:55 PM

as far as supreme court order on the subject people who have suffered only understands, this order is perfectly correct. As these people create probelums and made other people suffer and also report to police (no mention to write with help of some same claded netas)who in turn arrest innocent and try to extract as much as possible from them which means suffer from both sides. Clear cut example of Delhi chief secretary's recent meeting with CM.

sc/st act
by jkj on Apr 10, 2018 02:54 PM

Before asking whether there is any act in the world which is not misused, one should ask whether there is any such reservation caste based act for complaint. This can happen only in Idia where all citizens are equal but some are more equal than others. (Predicted by George Orwell)

Who are benefited out of Reservation policy of GOI?
by suresh nanda on Apr 10, 2018 02:45 PM

The poor dalits , SC & ST people are not getting the benefits of reservation policy of GOI. Only those families in politics or already in employment are only benefited from this reservation policy. Further you will find fake SC/ST people who are getting SC/ST certificate in illegal manner are also benefited for 2-3 generations which can be examined as most of the SCs belongs to other than Hindu community where reservation is not allowed.

SC VERDICT ON SC/ST ACT
by Dadhi Dash on Apr 10, 2018 02:42 PM

Supreme Court is absolutely right in their judgement. This act is being misused not by dalits but also by upper caste to take revenge on some by utilising the service of a dalit. Every thing is salable in this country. High time this caste market is shut down.

Supreme Court just upholds constitutional rights of individual
by Suryanarayana V. S. on Apr 10, 2018 02:41 PM

My sincere feelings for the suffering communities.
But everyone should think.
Courts are the only institutions which will (should) guarantee and uphold constitutional rights of individual.
Courst may be saying to just investigate a bit atleast in some cases instead of immediate arrest on a receiving a complaint.
If the same power to complain and make immediate arrest facility is given to some more people like say a lady or a senior citizen or child or a handicapped person or persons in extreme poverty ; then the same agitating people will fight back to stop such powers. Because this power can one day become weapon for some and also problem for others. Therefore, genuine cases should be identified by the authority and act accordingly/immediately.

Obsession with SC/ST Act
by Manian on Apr 10, 2018 02:31 PM  | Hide replies

The writer gives the impression that the SC has done with the Atrocities against SC/ST Act. The writer has failed to understand how this was misused not less than by the Ex-Judge of Madras Highcourt who have petitioned against the Supreme court judges that he is being harassed and has invoked this act. Ultimately he had to taken rest peacefully because of a contempt case. SC in its wisdom has rightfully has laid down the procedure how a person could be arrested based on the complaint. The Act when it was promulgated 30 years before required protection and now every SC/ST knows his or her right and it is right on the part of the SC to have laid the set of procedure before a person could be arrested.

Well, I am sick and tired of this cast system in India. A truely biased system. In tamilnadu we have the maximum reservation system because of vote bank politics. The system of upper cast paying for the education of sc/st is totally unprofessional. Let this government pull out the plug from this cast based polotics.

supreme court
by dalip bakshi on Apr 10, 2018 02:02 PM

the writer should have respect for the constitution of India . which clearly says that independence is the birthright of every citizen . And the supreme court has only upheld that . If any law is violating this basic tenet of the constitution it is violating the personal freedom . every person has a right to free trial.

What is he talking about?
by rajarshi banerjee on Apr 10, 2018 01:59 PM  | Hide replies

Even if 1 out 10 cases are false why should an innocent get punished for no fault of his own? Our jurisprudence rests on the premise that let a 100 guilty go scot free but not one innocent should be punished. This act turns the entire jurisprudence on its head & yet SC has just asked for a investigation before arrest. Not diluted anything in the provisions or clauses of the act.

My dear you are so blatantly casteist , that you do not even comphrehed what you read.
Where is it said that an innocent was punished . At the worst it is only harassment. That itself is a deterrent for any body from a respectful background but the upper caste street urchins, take out their inferiority on the weaker caste cheered/egged on by the silent majority.

Even if it is 1 out of 10, it is wrong.
by rajarshi banerjee on Apr 10, 2018 01:55 PM

Firstly the author should get his facts right. The false cases filed in urban areas are 60% though in rural areas it is about 33%. Most importantly our jurisprudence says, let 100 guilty go scot free lest one innocent gets punished so what rubbish is he talking about 1 out of 10. Even if one out of 100 cases were actually false, it should NOT happen that way.
