Rewriting the constitution
by Krishnan PM on Jan 25, 2007 01:38 PM

yes - pls rewrite the constitution with the following:
1. No one should be an MP [Lok & Rajya Sabha] / MLA / MLC for more than 3 terms, whether continuously or severally. If a person stands and gets elected for more than 3 terms, one has to forego any and all remuneration from the exchequer. Even then one cannot stand for more than 5 terms - continuously or severally.
2. No relation of one who has already become an MP/ MLA / MLC etc - be allowed to stand for election of any sort for any elected post.
3. No one above 70 should be allowed to stand for any type of election.
4. Reservation should be economically based and not caste and/or religion based
5. Have a uniform civil code for the whole country - which is based more on everyday living and not just religion / caste practices
6. Bureaucrats should be made responsible for all their actions - accountability should be the main buzz word of the rewritted constitution
7. No one who is not a born citizen of this country should be allowed to stand for any election, including the President.

public referendum
by Dhruba Mukherjee on Jan 25, 2007 01:09 PM

with levels of distrust for politicians very high the only way to go ahead with such changes is through a public referendum as is the case in many countries.

The supreme court should decide what should and what should not go for a referendum as this is an expensive affair.

Re-Writing the Indian Constitution

Yes the Indian Constitution must be re-written. To Me the million Dollar question is who will be assigned the job to re-write the Constitution? Do you think the presant Political Class and the Bearocrats who look in to self intrest and their vote bank shall do Justice to re-write the constitution, which is blend of USSR, American and British Constitution. A Country which is independent since 1946 and its all Laws are the carbon copy of the British Laws and still the Supreme Courtin India accepts the Judgement of the British Privy Council can draft a Constitution of its own? We do need a constitution of our own basing the more than one billion of people of different beliefs and faith. The Country was devided on the basis of Religion and Pakistan was created for Muslims then how Muslims are prevelaged citizen in this Country to day whose population is rising in Geometrical progression. In times to come the other faith people will come in minority in comparision of the Muslims. Therfore I believe the the New constitution should not have any chapter on reservaton adn Article 358 giving special status to any state. india is one it should of equal right for allirrespective of religion cast and creade. Evry one should follow the law of the land. No religious laws or sereiet should be allowed to be followed.

constitutional amendments
by prashant ruia on Jan 25, 2007 12:38 PM

Everyone might not be aware that while writing the first edition of our constituition, Dr. Ambedkar had categorically mentioned about the reservation policy of govt. to be implemented only for the first 10 years. The successive govrernments starting from nehru has used this as a mass vote bank and it is still being practised. in fact reservation reminds the beneficiaries that they will remain neglected for rest of there lives. the govt.in its pursuit of votes has now devised a method where they can go and collect the votes and make them stay where they are for centuries.
The whole idea of reservation by ambedkar is a farce. he simply carried forward the legacy of britishers of divide and rule. politicians and only politicians are reaping the benefit of the same. Reservation has brought corruption, casteism, non competence and shame to the nation

by RAGHU NANDA on Jan 25, 2007 12:28 PM

Yes. Constittuion to be re-write based on the current situtation & future. However, some basic aspects to be retained without change. The main concept of the Constitution to be Equal Rights to all the People irrespective of Caste, Religion etc., All are one in India. There is no need for special attention to Minorties.

What is the need of re-writing ,it is the implimentation problem
by Sri Dasari Srinivas on Jan 25, 2007 12:27 PM

First of all we have to asks ourselfs what is the need of re-writing the constitution .
As far as constitution basic structure is concerned and the Articles statements are concerened ,they are very flexible in accordance with changing times and situations.
In year 2000,the then NDA govt. made some attempts in re-writting/looked into it with the
changing needs ,but Justice M.Venkatachalaiah, chairman of the comm. had stated that there is no need of re-writting it,but need to amend some laws which needs to change according to changing situations.
As far as constitution articles enforcement is concerned, the entire political gamut has failed for the sake of their/relatives benefit is concerned.
In INDIA ,IT IS OPEN SECRETE THAT THE ECONOMY IS IN FEW HADS ONLY I.E. IN THE POLITICIANS/BIG ZAMINDARS/AND LIKE.
In this context, where is the proper implimentation of land reforms, where is the proper addressing of SC/ST and Backward caste problems, for which we are just SAYING there is no caste feeling and like, but in reality that exits even today in every form and every situation,WHAT IS THE REMEDY FOR THIS HENEOUS CRIME.
IT IS A CHALLENGE FOR THE ENTIRE HUMAN BEINGS,CAN ANY LAW/ARTICLE WILL CHECK/REMOVE THE CASTE PREJUDICE.

THIS IS VERY SERIOUS IN THESE DAYS ALSO.

SO,TO CONCLUDE ,WE HAVE TO IMPLIMENT THE PRESENT CONSTITUTION (WITH SOME AMENDMENTS)IN LETTER AND SPIRIT.

YES & NO!
by Harshavardhan Gampalahalli on Jan 25, 2007 12:26 PM

Well, Ideally speaking I think it is necessary to refine if not re write the constitution to reflect the present day INDIAN scenario and hence the YES in my title. However, Given the attitude of the Indian political parties & polititians, I doubt if justice would be made to such a re-writing of the constitution without politicising it for Votebank gains!!! & hence the NO in my title.
In comparision of the 2 options it is better not to meddle with the constitution at the present juncture.
