why was the maid's husband & child arrested?
by chintu phoenix on Dec 17, 2013 04:47 PM

why was the maid's husband & child arrested? on what grounds? this to me is a classic example of the indian state being for the elite, by the elite, of the elite. why is the maid's family being hounded? why did the maid abscond? is it due to ill-treatment? i hope the US teaches the indian government & judicial system a lesson!!

US STATE vs INDIAN STATE - The intrinsic differences!
by Kabeer on Dec 17, 2013 04:02 PM  | Hide replies

Indian State and the US State work differently.

The Indian State is formed by the British; hence, as was the need of the Govt in those days, the State always works in favour of the Govt rather than the people. That was created such that the colonial Govt should be protected first and not the people.

So, police and all the law enforcement agencies do not work independently but on the orders of the Govt.

In the US it is different.

The US State works for the people of the US and not the Govt of the US. Hence, the police of the US states or even the FBI do not take cognizance of the US State Dept or even the President or even the Senate/Congress.

There are laws laid out and they just enforce them irrespective of the fact that the person is an Envoy or its own Black citizen.

No one is an exception; right from the richest corporate honcho or even the IMF CHief (Remember that the former IMF Chief was hauled from his aircraft, even after he checked in and boarded the aircraft and was arrested on rappe charges) US police are not questioned by the Govt as to why they did not allow respect to the IMF CHief.

In India it is different, it is still colonial; so the Govt is all too powerful and has full control on the State even if the State doesnot enforce the law there the Govt to support it.

Indian Govt may be doing as if in a revenge manner, but the poor US Govt can do nothing to stop its Police or other agencies.

Now, if India doesnt arrest Warren Anderson, it is its fault!

Thats half truth.

When the embassy and Indian Govt revoked the maid's passport and informed US authorities that she is a fugitive and not associated anymore with Indian HC, in as early as July 2013, why were these socalled 'law enforcers' in US havent replied to the embassy or taken up with Indian Govt.

There is something like diplomatic immunity and Geneva convention to be considered when you are taking action against a consular general. How US doesnt follow them ?

Worse is, even if there is some lacuna in any process, how can they strip search, handcuff, keep her in a cell with drug abusers, criminals while her only mistake is a possible under paying to her maid. This is not a criminal offence even according to US Laws until its proved in courts.

US is clearly playing underhand to embarass Indian govt, by colluding with those forces working over time to malign India's image there.

Unlike in India firearms are carried by many US residents.

This is to allow the resident to protect himself or herself in defence in the absence or late arrival of police.

In India the Govt allows the victim to die in the hands of the attacker-Delhi gang raape case is an example.

The reason why I am saying this is in justification of the police there to handcuff the arrested. This is done to protect the police from the arrested resorting to a firearm and kill policemen.

That is a common practice; even the IMF Chief was handcuffed as he was charged with a crime.

Stip search is legally allowed and there is no provison to keep drug case arrests differently from the normal ones while in custody. A criminally charged one is a criminally charged. There is no difference.

Indians may ask the US to change its laws adn treat differently charged be treated differently, but that is a different matter.

I guess you are referring the CIA Agent Ramond in Lahore killings.

There the US was clearly in the wrong.

It is the weakness of the Pakistani Govt that allowed Raymong James to get out of Pak.

In no country there is any diplomatic immunity for any one who is caught red handed while killing two people.

by Thankachan on Dec 17, 2013 03:53 PM  | Hide replies

Indians are very intelligent and others are foolish & hence indian industrialist never pay a standard salary for their labours. This policy cannot be followed in other countries. Devyani should be sacked from the services immediately and put under trial.

STOP taling and DO something first
by lee on Dec 17, 2013 03:27 PM  | Hide replies

India is number 1 in crying and complaining. Instead they must do something to one of the US consulate official who could be a highly ranked one and insult them in a lawful way, humiliate him/her and bring it to equal terms against US. Then India should say that it was a honest mistake and forget it.

It is doing something.

It has withdrawn VIP treatment of US diplomats like 16 year old petulant beaches unfriend other 16 year olds on FB!

It has removed barricades that guard US consulates.

US should take this as a breach of its security and impose massive sanctions against India!

This is typical behavior of Congress Party ...... spiting the hand that feeds it!

Like they mistreat H i n d u tax payers whose money they use to fund their minority appeasement extravaganzas, the Congress Party is trying spite the US!

It forgets that the US is not like Indian H i n d u people who will take these shenanigans lying down!

Hopefully, the US will put its size 20 foot in Congress Party's back side and show it who's the boss!
