Can statutory Provisions against Bribe culture succeed?
by D goel on Apr 18, 2013 08:21 AM

D. goel pkl. , moorning8.10AM. Thursday, April 18, 2013.
Readingthe details of thecomprehensivestatutes made against Bribery under the proposednew anti Bribery Act , would prove effective in making /running the Government ,Offices and their Public Dealings on different matters really get purged of canker of prevailing Bribery?
I donot think thweLaws ofGovernment run by corrupt eements in our elite who steeped in every form of Larceny and thriving by flouting Morality could ever haveany serious intention of acting on farcical legislation , that are done to hoodwink Masses to believe that elite is doing all that is possible within the governance of State.it is a sham only disclosing hypocritical Leadership of this unfortunate Country. I do not understand why the root cause is not identified.... root cause is Govt employees are not trained to provide good service to public... they are not liable for the salary they get..

there are enough statutes in the book to punish the bribe receiver, no need for another law. present law will punish the bribe giver, exonerating the bribe taker government servant, politician. hiow sad! V Ramanathan village renasamudram

Govt servants never perform their duties without they get something. Anna citizen chapter should be implemented. Norms followed for corruption is a stealth behaviour including our prime minister.

Wrong name for the law.
by American Indian on Apr 18, 2013 06:25 AM  | Hide replies

The name for the law is a misnomer. Rather than "Prevention of Corruption Law" it should be called "Prevention of detection of Corruption Law". By making bribe giving a jailable offence the new law ensures no bribery cases get reported. The govt can then take credit that it brought down corruption while it just brushed it under the carpet.
The reason why a corrupt officer/polititian takes bribe is desire for money. Hit him where it hurts most by
(a) striping him of the powers that enabled him him to demand bribe it dismiss him and bar him from any govt/political post in future.
(b) Impose a monetary penalty n(decide a figure say 5/10) times the bribery ammount failure to pay which should result in jailtime proportional to the shortfall in the penalty paid.
To avoid hounding of honest officers/politicians the above punishments should triger only after court conviction and can be overruled by a higher court(eg if apealed at high court/supreme court).
The reason why a common man(includes some industrialists) give bribes is to get some undeserved(may be out of turn) govt favor eg contract.
Proof of bribery giving should be punished by revoking of said favor eg. cancelation of contract(to be rebid) with all govt paid money to be repayed back. All goods/services delivered for the money continue to be govt property but Jailtime for failure to repay paid money in entirety.

Since Sting operators by deffn did not earn money from the favor they got for bribe they dont get penalized when they declare the bribe(just the favor which they didnt want anyway gets revoked).

The big difference from the govt proposed law is that in govt proposed law sting operators can be jailed for giving bribe which deters them from coming out with the truth.
