UCC or Hindu Civil Code?

Continuing the discussion, if UCC is made, it should be made on the basis of justice. Equality should be present in education, quality of life, provision of basic needs, providing oppurtunities etc. Strict laws should be made to prevent selective abortions of female foetus, which is prevalent in our country.

I feel, if the muslim law is observed strictly in accordance with shariat, by our courts, muslims of our country will not face any problems at all. For instance, the groom is supposed to give a mutually agreed amount of money or property as mahr, to the bride, at the time of wedding.
But in our country,it is just agreed upon and not given. Hence the maintenance money to the wife comes into picture, when a divorce occurs(like in Shah Bano case).
When the male initiates the divorce, the mahr is not supposed to be given back to him. If the wife opts for divorce(khula), husband has the right to ask for full or part of mahr. Neither of them are supposed to prove anything against their spouse in both the cases.
But I'm sorry to say that most of the muslims do not follow this. Instead of going for UCC,it's enough if Islamic law is implemented properly by the courts, for muslims.

Further to my previous posting, the word "justice" should be used in place of "equality". Islam does not regard men and women as equal in matters where regarding them as equal would result in injustice to one of them, because equality that is inappropriate is a severe form of injustice.
Women are like men in many aspects and they differ from them in others. Most of the rulings of Islam apply to men and women equally. In cases where a distinction is made between the sexes, the Muslim regards that as a mercy from the Creator and a sign of His knowledge of His creation, but the ignorant see it as oppression and injustice, so they stubbornly insist on claiming that men and women are the same.
Think what would be the result if men are asked to eat an amount of food equal to that of what women eat. It can't be done because it's against the laws of creation. Whatever a woman eats and however she exercises, she can't develop enough strength of a normal man because it's against her nature. There might be a handful of exceptions but laws are made based on generality. How would a man give birth to a child and breastfeed the baby? It's impossible because it's against the laws of creation.

You have spoken like a politician--raised an issue but given very little sensible proof.

Your example of eating capabilities of a man and woman showing their differences is completely irrelevant! What about more social issues like marriage and divorce? Nobody claims "physical and comprehensive" equality among men and women! Everybody does claim social equality. I am sure you won't oppose to the fact that atleast socially men and women are totally equal! Can you justify a woman being so inhumanely divorced by merely uttering some words? Imagine you being disowned by someone like that! And further, refusal of maintenance! Where would you go in such a situation my friend?

Though you haven't disclosed your name fully, I am confident you are a male--try looking at it from the female's perspective for once. Law and religion looks fair and fine so long as you are not the one paying!

From the entire column, I agree only with one point made by the author. I agree that UCC would be just a Hindu code if made by BJP and its "allies".

Some of the odd things in the column:
1. The anology of Hindus' obsession with cow doesn't apply to muslims' love for their law. It's well known that Hindus used to consume beef centuries ago but later started worshipping the cow, for some reason. In contrast, muslims never disregarded their law, apart from some muslim rulers who went astray and picked up any law from anybody.

2. The kind of gender equality conceived by many is simply skewed. Many say that males and females are "equal" in every aspect, which is simply false. This concept of equality propagated by many makes everybody equal, whether it's parents and children, ruler and subject etc, in terms of authority. As a result, children have started disobeying their parents, people have started mocking the law and order and other ill-effects have surfaced.
Equality should be present in living condition, education and respect given to male and female, but it can't be present in everything, because male and female are different in many aspects. I will elaborate in post 2.
