The author of this News George Joseph is not aware of Memorandum on H1b released on 08th Jan10. Dont create false news or false interpretation. " The new rule stipulates that those who arrive on a work visa should 'arrive at the place of work" - this is 100% fasle interpretation.

Too complicated issue but anyways we dont have any right to pinpoint other country policies ... if we work there we have to obey there rules.. in india itself states are fightin against each other... a person coming from different state is seen as a outsider...

Rediff, get your fact right before publishing important news like this. USCIS came up with new memo on 1/8/2010 which defined the new employee-employer relationship. Small company consultants woking at third party client location may have to suffer because of the new rule.It does not say anywhere that "those who arrive on a work visa should arrive at the place of work".

so, as per these "new" rules, can an H1B work at a client of the consulting company? do the client and the hiring consulting company have to colocated? in same town? in the same metro area?

the whole idea sounds bizzare to me

According to the new rule getting and renewing H1's will be difficult for the small companies because they just run the pay roll of the constultants and don't have any control on the day to day activities at the client location which is voilating the new employee-employer relationship.
Yeah I agree with you that its a stupid rule and legal immigrants will have to suffer.

If consultants can produce evidence that they are under payrol of petitioner or they are are geting health or other benefits and also petitioner is filing taxes for the employee then Employer-Employee relation does exist. The employer should have the 'actual' control or the 'right' to control the employee, to hire, fire, pay, and to decide when, where, and how the employee will be employed.

Rediff is printing different story here. False propoganda. The H1B has to go to the direct employer location not the third party.
At issue is a memo on the definition of "Employee-employer" relationship that the USCIS came up with a while ago. It affects H1Bs working at third party client sites.

The H1B who dont have complete knowledge who is direct employer and who is third party are unable to answer the questions put up by the USCIS and most of the H1B arrive to work for third party only and they are sent back

If Indians are going to the US on HIB it is because they are needed there. If they are stopped, the concerned companies will oursource the jobs to India and other countries. Either way, the US authorities are making a fool of themselves.

These jobs exist in the US only because they cannot be off-shored, else they would have been moved to India/China or Brazil a long time ago.

If the employer cannot find cheap h-1b labor, then he has no recourse but to hire non-visa holders - which should easy enough in this economy as there are plenty of qualified & jobless people, who are willing to work for lower wages.

That is the idea...

People who had been through this h1b and got GC does not support H1b as they are not effected. The major problem with indians is they have differences in thier community itself. GC hates H1b and Desi citizens hate GC. It goes like this. Now GC and Citizens are happy becoz they will not have H1b competition.

once a visa issued is it not legally binding for the immigration of that country to allow the travellor a hassle free entry.absurd that rule stipulates that one should deboard at the place of work.what if there is no airport in that area then the imigration should make arrangements that straight from the airport the person is escorted to the place of work with security guards so he does not get down anyplace else.have faced the same situation though they let me in once while deplaning in w.europe and i fully sympathise with the deported.like some posts mention that the us is no longer a goose which lays golden eggs.

As some lawyer said, even today, if the US opened its doors to allow free and unrestricted immigration, over 80% of Indians will migrate.

That is a highly overstimated no , else people would do a 3 month course and get h1b just like they do in AP but this has not happened proof is the slow filling of h1b quota this year .


Also many people in India and infact rest if the world still do not know the severe problems they would face in the US once they land and start settling down here right from

second to third class citizen status

severe weather atleast half of the year

hidden costs of owning house

lack of good culture

high rates of drug and sexual abuse


high rate of gun ownership

increasingly unprofessional work enviroment

impact of genocide of native indians centuries ago but the effect of it still is felt at a person , society level ....

Although the standard of living in US is better than India in terms of machines that are provided, secondary citizen is not better anywhere you are treated secondary. In India, you always feel its your country, it feels heavenly when I return every year for vacation. Things have improved leaps and bounds every year and I think primary Indian citizenship is irreplaceable by anything secondary, because, I am the son of soil. If you sold your self respect for money, thats your choice, its better for you, not for me.

Sorry friend,

All the desis in the US are educated enough to get excellent work in India. And yet, they are in the US, including IIT and IIM grads. If the IIT or IIM grad - with all the opportunities in India - chooses the US over India, then someone from a lesser school/college has a higher probability of preferring the US over India.

Look at the H-1b quota. Back during the Y2K season (late 90s), it used to take months to fill up the quota. Now it fills up in exactly 1 day. The only reason it took longer in 2009 is because of the crackdown.

So you will agree that the US craze has only increased over the years.

It is not as absurd as rediff claims. H-1bs are filed by location. As long as the individual has his paperwork in order and an itinerary leading to the right destination, he should be fine.

Even though I am on H1b too, its a right move in this regard. Desi consultants have made life hell to genuine guys. Associates are called even when they have no projects in hand,... they lie ab inhouse project to USCIS, thereafter, these associates find some chacha mama bhatija sala somewhere in US and stay with them and try to get any project.. sometimes even 6 people stay in 1 BR apt.

Consultants with hope?? Arent they the one who are well aware of what they are doing and their masters are doing... they are no ignorant so why should they be spared? Anyway, their deporting affects the employer too
