In first place before we blame USA, why the hell we Indians decide to go and work in US they didn't send us the Invitation we self invite and most of the H1B frauds are done by the Indian companies in USA and rest is done by the big Indian companies.
When the unemployment is 10% in USA the citizens don't want to loose their job to foreign workers like us. If this have happened in India, we would have burnt foreign workers. Lets take for an example Maharastrians don't wann other state people to come and work and vice versa. North hate south and vice versa. So, when we have infinite number of problems to deal with we cannot blame other countries. So wake up guys

If they Say we pay you more Is'nt it invitation? Take for instance in your place someone is selling Sugar Rs10/Kg you will go and buy it from that shop. offering the H1B is kind invitation.

Few pieces of advise:

1).As far as possible land at your employer city and if you do not have direct flight to the employer location show them the proof your connecting flight.

2). If you have to go to client's location due to time limitations & urgency I would suggest to carry LCA(Labor condition Application) Document. which is a amendment made by your employer to your petition when you change the location of work. This document should be a legitimate proof that you can work in that location. This may not save you from deportation as the port of entry officials are process driven and do not have patience to understand what you say. But this can be a good document and can be vital document to save you.

3). If faced by deportation (ER) go back on your own expense...

I remember recently an Indian celebrity had unnecessarily made too much nonsense and severely hurt the image of Indians by his arrogance at Newark Airport. Such people make life difficult for his fellow countrymen.

The companies who send their people to work abroad should make sure that people directly reach to the nearest airport to the location. The PNR number and the ticket has all flight connection.

The problem happens when people are not able to give convincing answers to the questions asked by INS agents. Many times I-94 is not properly filled and attracts difficult questions.

When I visited US for the first time in 1995, it was a Red Carpet welcome. I was amazed by courtesy of INS agents and airport staff at JFK, Newark or Seatac.

But my entry in US in the last 7-8 years have not been that good, and the last 3 years I found them very rough even I have all clean records of B1 and L1. But they are not to blame. Things in this world have changed dramatically since 9/11.

So, I would advise visitors to US should take adequate precaution and hold all documents/evidences to prove your trip a genuine one.Please stay calm and reply to the INS questions with confidence.

Seriously,
i do not understand the concept of lower paid immigrants. Every employee on H1B should be paid the minimum salary stipulated in LCA document. And most if not always, companies pay 5k more than that amount. I have been in US for almost 7yrs and every american i know has always earned less than me for the same job we did. Only difference being , i am a employee with a science degree and these guys are not.

Only illegal immigrants are the ones paid lower salary than american counter part. So where does the argument of replacing a local with a immigrant , because he can be paid lower comes in picture. Corporate america always will replace higher paid with lower paid as long as the service level is not affected.

Indian companies like Infy, Wipro, TCS mostly recruit indians, as we understand each other, and our Indian managers can easily extract more work from a Indian when compared to an non Indian.

Do not mingle with other passengers.
Do not look around until you have reached primary inspection counter.
Do not laugh or joke, appear overly friendly or do not even appear panicked.

When you reach primary exam counter:
Look officer in the eye.
Hand over passport and H1 I797 notice.
Keep quiet (very important).
Answer in shortest possible way, what is asked.
Do not volunteer information on your own.
If threatened remain silent.
If forced to sign something, make sure you understand what you are signing and sign as your name ucc 1-207

they get visas by paying huge sums to fake companies who make fake documents for them... they come here and disappear working jobs suitable for their low qualification... as usual deserving h1b visa holders suffer due to this fraud...

If you face ER at US airport and are forced to sign the documents, sign as Below:

"Under Protest" , "Without Prejudice" , "With rights reserved" or

UCC 1-207

For eg: my signature would be Techno Geek: "UCC 1-207"

If the officer asks what is that you can say, that is my signature. or "look it up."

The question is when will India change for better ? why do people want to go and settle/work abroad even in todays times ??

We lack even basic amenities even for the big cities forget the villages. Our law and order is in shambles and people do not trust the cops as well as courts.

There is an underlying dismal feeling of corruption and nepotism driving everything and common man has no justice which is scary for a common man who has no big contacts or money.

Indians may have a lot of potential to take this country to great heights but unless that potential is realized it will never be recognised.

Its of no use praising NRI's who have done greatwork abroad because that does not benefit India in any way only when people work here and show good results can we recognize it.

But the problem is not just India every single nation and possibly state of nation which is backward should change for better only then this issue of people scrambling to go to better places and some getting rejected/humiliated will be resolved.

India can never be great till its citizens become great. We dont need one M K Gandhi we need billions of them today.

Well, there are 2 main issues involvled:
1. Will Indian Govt. be able to provide jobs for all the needy? More than 50% of the jobs are gone on reservation and still, they want to increase the percentage of reservations.
2. Work atmosphere in India: No one wants to do any serious work. Politics plays an upperhand everywhere. On the contrary, see the situation outside. Those who work sincerely are appreciated. This never happens in India.
When will these things change?

You are right. Even in India things are no good either.

I know several people in IT sector who lost their jobs in the last 6 months and yet jobless.

Thank god that the private companies are still free to employ people on merit. The contribution of govt in employment generation is less than 3 % and meritorious people are still finding jobs in private sectors in the last decade.

Only the overambitious people who have spent lakhs of rupees on getting a professional degree are crazy at going abroad and make fast or more money at those salaries.

Otherwise for a less ambitious, content people having studied on merit basis not donation basis, India offers exellent opportunities at all levels.

so?? u keep going outside n nobody wants to fix whats goin wrong in India? Most of the private organizations are good enuf without too much of politics n things can improve when we become next level of management n HR.
Just jumping off to a better place wud lead to no where.
Earn as much as u can but come back n do some good to the country, if u r soo greedy of euros n dollars.

The answer lies in the Indian companies offering their services on-site at rock bottom peices, even when then can afford to offer off-shore services at reasonably competitive rates and still get the contracts. This competitive offerings by Indian companies are being exploited by american companies to their advantages from last 15-18 years and still washing off their hands when it comes to any regulatory issues.

There is also another element of NRIs being given special status in states like Andhra Pradesh, Punjab, Gujrat etc, which prompts people from these places to go abroad by hook or crook.

Over 90% H1-B are grabbled by Indian IT biggies. They send their people on bench at very low cost ($20/day) and pay the salary only when they are hired by an American company.

I guess this is too much of generalization and over stating of some of under lying issues. Every society has it's own problems and this is not very different from what is happening in US today. Otherwise - why would a country as developed as US would target highly educated and law abiding, tax paying individuals for such silly reasons as mentioned above.

What do you think is generalization and over stating ? It is a common problem prevalent accross the world.

Those countries / societies which work hard and do well build better countries/economies and often societies.

All I am saying is that everyone should work towards such a goal rather than jumping on something that someone else has built.

Not that society should not have people movement and interaction albeit it should but not at the scale and in condition we are seeing today.

Nothing can help you from your own lack of self-respect and esteem.

It is ok if India remains under-developed. We can live with power-cuts, water scarcity, improper roads, etc. Indians will not have any issues. But the justice had died in India. Only powerful people and rich can get the help from Indian law. When Indian law starts delivering things will change. But when these things are going to happen is question now for all Indians.
