TCS and Infosys were the first to introduce boy shopping in USA by sending highly qualified IIT graduates to remote corners of USA to work for US companies at stipends that is lower than that of the minimum wage i.e. the Indian IIT engineer earns less than the sweeper or peon in US. No wonder TCS or Infosys could never get close anywhere to Bill Gates Microsoft, although they too have been in the It market for as many years. No wonder the total foreign revenue that India earns from these Indian IT companies is less than what India earns as remittance that New York Indian Taxi drivers send. We only focus on IT because we consider it as elite like Brahmins enjoyed high status in Vedic India. I welcome the move by USA. Qualified Indians cannot be treated shabbily by Indian pay masters to work for a song for white clients, just because they pay in dollars and which is lower than the minimum wage paid to US uneducated worker.There needs to be a equal level playing field be it in India or USA. It is this circumventing of US laws by sending contract workers is what ailing both Indians as well as US citizens.

Sirji.. for your information, these people do not abuse H1b as much as small desi comps. These company send people abroad only when they have work for them and pay them while they are here. Come on.. you frustu person. chill out on comps that made India an economic giant

The sad part is that I think TCS, Infosys and other body shoppers qualify with this rule unlike small time body shopping companies. They have the "right to control" because they usually send a team of people to the project site and are supposed to have a project lead/mgr supervsing them. The work assignment is supposed to be done by them instead of the clients. Performance reviews of the H1Bs are conducted by TCS instead of the clients. So TCS qualifies for having "right to control"

you are the most ignorant person that I know of. TCS and Infosys pay there employees in US as well and not US clients. And they do have to pay an decent min. amount decided to H1 b employees and which is quite compatible if not equal or more than the people doing same kind of IT work there. And TCS or Infosys is not a body shopping firm like many other small desi consultancy firms that work from US or small towns of AP. TCS & Infosys hire the employees they send them to US for particular projects, pay them in US(which is 5 to 10 times more than what he would have earned in India.) and call them back when project is finished. And that is why Indians. And for your KI clients do treat this employees very well(better than India boses).

there are 2 aspects to this.. one is the actual rule and the other is the interpretation/timing of enforcement of the rule..
obviously.. the interpretation and enforcement of the rule was not done correctly..

We ll lose H1B but same work we will get in India.

India IT market will boom soon and blast like anything. Only thing be ready with resources to open small IT consulting company. Why we ll go there and spend huge on stay and food same we will save here. Now try getting a USA phone number in India and call all companies for project outsource privately. You will earn more that H1B am sure.
What is happening is always good. OBAMA can change his country cant change our fate. We Indians are really more talent than americans, so OBAMA is scaring to enter H1B indian guys.

No country is better than your home country however bad it is.
UK/US... will give you more money. But IT guys can earn good money in india itself.
White people will always consider (in their mind) asians as secondary. They may not show it outside.
If you are ok with that, live that life.
I am planning to work 2 years in US, earn 50-60L and go back to india. I am ok for the discrimination for 2 years

Desi maverick, Indians, are under no obligation to live in US for ever. The moment americans see that you like ur native land more than their land, they do not like you. There is nothing wrong in leaving US after short term if you did not break any laws.

It is filed by employer
It is american employers that fire local people
Indian people get their job on their merit, you can blame it on low wages but upto you.

I have seen many desis share this kind of mentality....there is nothing wrong with the thinking but what matters is the way it is implemented...
I have seen MANY desis ( and Not Everyone though ) paint a bad picture of the country by the way they live in the US...people who refrain from washing clothes to save $1 laundry cost , seen desis getting caught trying to board buses with expired passes and what not....
Saving money and coming back is a good thing but what stinks is the "DONT CARE ATTITUDE"...which comes out of irresposibility ...thats why we see people breaking rules at every instance just to get the extra buck -- frm exceeding max no, of occupancy in apamnts to even cheaper acts like not clearing off balances / debt before leaving country and showing falsified Tax submission docs to get more money from IRS ...
and they do this fearlessly because they know one thing...we are here for 1 to 2 yr...just earn money "however you can"....and then never look back...no credit history or bad records to worry about as people know wthat they would never come back...
We should be living with "integrity" wherever we are...doesnt matter whether its India , US , UK or anywhere else

Its too late. These are small annoyances. US IT industry would collapse without India. All the big players are present in India be it IBM, Accenture and the likes. Indian lobby is too strong to be ignored in the US. Above all US is not a petty country like Australia.
