SC Judges - Press Conference

I am just wondering the way these 4 SC Judges have come out and spoken as if Democracy is in Danger. Mr. Rahul without knowing the context he has started to use for their benefit(Democracy is in Danger). Indian Democracy was in danger only his grand mother has imposed Emergency. Now the battle is between two political ideologies(Left - Congress Vs Right - BJP). There is no question of danger for democracy in India.If the job of the judges are to go through the cases and provide fair judgement ,without bias, why these 4 SC judges are so worried about the case allocation to different benches. It seems that it is the Ego battle between these 4 judges Vs CJI. But these 4 SC Judges are trying to project as issue in Judiciary. Are these people agree for NJAC,IJS, Punishment to the wrong judgement etc which will make Judiciary a fair practicing department. If these 4 were for such type, we can say these people are doing good for India. I am wondering what Shekhar Gupta and D Raja were doing.Seems to be politically motivated

2G case-why it was declared only after Gujarat elections.maybe many more to come like this.there is no doubt that the central govt is behind this.
also Lalu,5000cr scam of andhra bank,why no one highlights.
for sure democracy is at stake.irrespective of religion.

This can be called in simple terms? Ego clash or personality clashes?I am as good as you are if not better so why should i listen to you?If all of them are equal,then why are they saying senior judges and junior judges?Why this contradiction?

There is something called the Memorandum of Procedure that Supreme court is bound to go by.

Read about it !

You will then begin to understand what the ruckus is all about.

As I write this I am not taking sides;my opinion on this I had said elsewhere.As discussion I would like to get informed or taught.I am no lawyer.How the word application of mind is to be used?I had been told of a case in early 1970s;I was a very junior fellow there.In a Govt. of India company one worker , man- handled a Superintendent of a well and disciplinedly running unit o9f that company, a company of high labour indiscipline.The G.M. was himself a one time trade union leader ,highly qualified ,respected and respectable gentle man.All the superintendents represented the case to G.M.for the same thing can happen to them .I don't write what I was told as to what those superintendents had told the G.M.No worker can be dismissed without giving an opportunity to defend,I was told that that worker was dismissed immediately and the General Manager had put in record as to why he had to take that action.R.Ponnambalam

But......you do not even know what the Memorandum of Procedure that the Collegium (that includes the Chief justice) has laid down for itself !!

And......is knowledge about the law meant for wayside defecator ignoramuses like you ?

Nagrajan, The Chief Justice of India has an absolute power to allocate cases to the various benches.The same power are also enjoyed by the Chief Justice of various High courts for their courts. The revolt of this four judges is on account of ego and personality clash and may be for some political reasons. This four judges are senior as per the list of seniority and are the members of collegium consisting of them and CJI for selectiion of judges for higher courts and other courts. This judges are not called senior judges and all the judges are treated equally.

We vote only after five years. Hoping constitutional functionaries would find ways to deal with their difficulties and we would judge our government when they come back for our vote. So even if we have an opinion the buk stops at the elected house I guess.

So what is the point and who is turning?

is miffed sore that the 4 judges let the cat out of the bag on him so unexpectedly !

He had obviously banked heavily on the fact that such an incident had never happened before in the history of the court ! The man was apparently very certain that he could just continue violating the laid down MOP and allocate cases to judges and benches of his choice without having to bother about the MOP !

He is so dumbstruck that he has been avoiding the press and has not even had a statement to make in his defence !

And behind him, komaaaaaali Modi and gas Shah are left even more dumbstruck and shell shocked !

The komaaaaaali party has an immense deal to gain among stuxpid north Indian voters if it gets made to order judgements in the Justice Loya case, the Aadhar case, the Ayodhya case, etc,. And the komaaaali and Gas Shah had found that they have got the *right* man in place in the chair of the chief justice of the top court to get such judgements !

The komaaaaali and Gas have always been sure about the depth of stuxpidity of common north Indian voters.

But......they now perhaps fear that even such stuxpid voters might begin to wonder about how gigantically corrupt the country has become !

These people ( judges) tried some thing. But it seems to have back fired as the whole nation questioning their act of going public.

They seem to have gotten carried away by the 'lets dismantle the system and build a new one' syndrome. But the nation did not approve of what they did. ANd rightly so.

Contemporary fashion demands that you go public and announce that the democracy is danger. So the judges seem to have resorted to just that.

If supreme court judges go public to wash their dirty linen, then we can not blame the politicians of the country.

I don't see any dictator rule. If so by now Vadra, Chidambaram, Sibal, Kursheed, Jairam Ramesh would all be behind bars. I am a senior citizen and had seen the emergency rule of dictatorship. I had been through the corruption rule of Congress and I had heard many voices its time India needed an army rule or a dictator rule. This is not dictator rule. The present Government is trying to put India on path of perfectness. I understand many feel uncomfortable when it is said link Adhar to everything. It may sound hard now but it is good for all. Congress is behind all this false propaganda to get back to power in 2019 nothing else.

do you thing the judge who died mysterious circumstances who probed Sharabuddin case which involved Amit shah has to be probed or not ? His wife raised the question of his death when he gone to attend friends function? there are so many instances of arm twisting by Modi government , where the CJI giver roaster to Jr judges to probe sensitive cases to favour government .Thats the these four judges came out open ?, Modi is arm twisting all institution include EC .
