In US there is a clawback rule

If a similar rule is applied here, where the builders, BMC who allowed this to happen in the first place will have to compensate the residents.
DO you know why these residents are getting punished ?
Because they tax paying, law abiding citizens.
Since they are law abiding apply the full course of law on them. That seems to be the system of India.

Please save them Mr. president. A lot of senior citizens are living in that compound. They should not get punished because of fault of builders. Why BMC didn't interfered when Campa Cola was being built? Please don't take their curse. Save them.

The Builder is always supported by the BMC,the law enforcing agencies,the various govt agencies,politicians,Babus , Musclemen the list is endless it is a known fact? almost everyday there is a judgement against some builder or the other by the consumer courts published in the papers.Statistics are available wih all the agencies regarding illegal buildings in mumbai ,buildings without OCS,Buildings without conveyance deed ......How can builders openly flout the laws ?Why is not a regulator in place to control these malpractices? what is the stamp duty being collected for? what is the registration for,how does it protect the buyer? There is a ministry in place for Housing if i am not mistaken then why is this mess ? what are we elected representatives for?

Why demolish Campa Cola compound ? Why not punish corrupt BMC officials who allowed illegal construction, illegal connections of water and power lines, and collected crores from the illegal occupants

My friend intended to purchase the flat in Campa Cola but as soon as he got to know that the building was illegal he did not purchase the flat.
Actually the cost of the flat was much less than the market rates. Hence I can confidently say that the residents knew that the flat was illegal.
They thought it was a bargain but unfortunately for the greedy people the bargain did not work out.

today, if I identify a flat to purchase , can you tell me which government authority will certify, if its meeting all govt. regulations. Supposing , i booked a flat and the construction started subsequently. how can i imagine the ill hearted ambitions of the builder to mis use fsi like in the case of campa cola. who is giving the occupancy certificates? ; municipal water; electricity; registration amount; gas connection; annual property tax etc. ??? answer

Urban Development Authority of the respective city. Just take a little trouble to enquire. First you have to get up from the chair. You can even ask the builder to show you the permissions and approvals.

Yes, if BMC succumbs to Campa cola residents vows, then many more such cases will surface in future. So taking a harsh step, which will be a lesson for BMC, buyers in future to take note of all such issues carefully prior to buying any residential and commercial buildings. I am not against campa coly residents or their views but they did a mistake and to that BMC is also a partner....

Isn't so???

so u are justifying an illegal activity. If u do not destroy campa cola then all mumbra illegal flats has to be legalized. some times for better changes hard steps required.

They should seize the promoters account and there properties with the money the the court has to provide flats to them. This is not the justice given to the Champa Cola residence

absurb demand...hold the builder by his collar, takehim to the court and seek adequate compensation for cheating harassment etc....but making lega an illegal construction ? no way...this will create a very dangerous precedence...
