The author's stance on the Italian marines crisis is unbelievable. I did not expect this from a senior diplomat.

The offence happened in the sea near the coast of India. The jurisdiction of trial is under dispute. The marines have been apprehended and are in the custody of the Indians. This is exactly what any nation would have done. If you dont like the legal system of India, who asked you to commit a crime against Indians. You could have done it elsewhere.

There is little place for terms like: "handled the situation well", "good relations", "whip up sentiments" etc.

They committed a crime against our citizens and hence need to face our law. If they could convince our courts that the trial needs to be held elsewhere, they could have done so. Nobody is denying them a fair trial. They were free to convince our independent judiciary and take the trial elsewhere.

Instead they have played the role of a cheap con-nation. They misused the generosity and fairness of the Indian judiciary and government. They have done a betrayal which is unprecedented.

Forever, it would be etched on the minds of the Indians that the Italians have done the greatest betrayal.

Any other country or even Indian government would have gone berserk by now.

The current UPA govt with the likes of Manmohan Singh, Sonia Gandhi and Salman Khurshid are completely unfit to handle such situations. They are only looking to take token measures and give the case a quite burial.

I am dismayed to find that the author does not refer in passing to fact that two indian lives were lost. If a crime is committed against indian citizen in the high seas, then does it mean that India should stand by and watch, because it is not in our "jurisdiction". The marines were "enticed" ashore, because of the need to observe decency. We could have well had our Navy intercept the Italian ship and force it to india, to safeguard our citizen. Shame on Indian diplomats.

Let's recount the facts before relying on half-truths!! No one denies that the Kerala police added beyond their jurisdictions - even the Supreme Court held it as such. But your 'analysis' fails to take into account that the Supreme Court also did not rule out the possibility of the crime occurring within the Indian waters and within the Exclusive Economic Zones where certain civil and criminal laws of India apply. Therefore, the Supreme Court fairly said that there should be a trial at the federal level in Delhi by a special court which was to speedily constituted and to examine, among other things, whether India could try the persons. Thereafter the Supreme Court, in the spirit of justice, allowed the marines to go home to vote on the basis of AFFIDAVITS presented by the marines AND the Italian ambassador that they would return in 4 weeks. Their not returning was a slap on the face of the goodwill and justice given by the Indian Supreme Court and indeed, the Indian establishment - including the much-touted diplomats. This is a typically myopic, bureaucratic way of looking at things and the sole perspective is foreign affairs. Essentially, we are justifying a contravention of international comity. Its like saying that a murder was justified because the deceased "asked for it." Introspect why Italy felt it could get away with this blatant disrespect for India and you will find that the Indian foreign affairs service is to blame. What an eyewash!!

The author of this article appears to be a defeatist and is willing to put India's pride at stake. The matter is simple. India were able to nab the killers and these killers should not allowed to go free. In case of US, India could not nab the killers and there was no way of bringing them to justice.
By letting go off the marines, India has projected the image of a weak nation who can country can go and slap around.

It is quite strange that the killers were even allowed to go outside the custody to exercise their voting rights or celebrate Christmas.

Would Italy have done the same to an Indian killer? Would any other country treat an Indian prisoner the same way? For God's sake, even Maldives does not think much of India!!!

Italy is part of NATO and India has no balls to tackle them. History has always indicated that India has always been a weak and a meek nation.

Yes India and Italy can reconcile. All Italy needs to do is ask India to Jump; and India has to ask - "How High".

Bhadrakumar has consistently been an anti-national and this post is no exception. By his twisted logic, even Kasab should not have been punished because he was not an Indian! This shooting incident occurred in India while the one involving US was not. Cleverly, this liar twists facts to his convenience. Also, he 'balances' the acts of congress with BJP's release of terrorists. The situation then was to secure release of Indian passengers which is not the case now. Bhadrakumar has perfected the art of lying shamelessly. When a retired government official opines that murder should be handled through diplomatic channels, it is time to examine our UPSC selection process and try to prevent anti-nationals from getting selected. But then we have a PM who is no different from Bhadrakumar types and is a indifferent and hopeless figurehead. No wonder the future of India seems bleak

I fully agree with the writer. India's handling of this episode has been inept to say the least. Again , where was the pride and judicial supremacy when BJP govt handed over terrorists to kidnappers of IA plane ?

1. The terrorists handed over were mere detainees and not convicts, if I am right.

2. If the SC comes in the way of releasing them, then if the hostages are killed, one can file a case of culpable homicide against the SC in SC itself.

Kabeer your logic is that of a 3 year old. One one hand you call them terrorists and in the same sentence call them 'mere detainees.' Agian, the Italians who fled were also not yet convicted, so were mere detainees too !!
If you'd filed a case of culpable homicide in the given scenario, both you and your case would have been thrown out. You need to be reminded that due to the weakness shown by the then spine1ess BJP government, India has since adopted a NO NEGOTIATION policy in such cases.
