Apply Gandhiyan principle of "mass violation of law"

A law cannot be implemented if there was a mass violation. This is what exactly followed by Ghandhi against British rulers.

Moderation and soft punishment (account blocking which already in place in most of the sites) will do a better Job than punishment under the court of law.

Post it and as long as you are not arrested its not offesive.
When they start feeling its offensive they will start pursuing you.
There will be more amends day in day out to suit all politicians and business magnets. Keep a tab on that.

If it is against a family, it is, but if it is against the Opposition party of a ruling party, it is not!

This guy...
by paul sebastian on Nov 01, 2012 07:33 PM  | Hide replies

First of all, this guy has to understand that it is not Sibals law, but India's law. Then, it may be arbitratory that which words are bad and which are abusive. It may depend on the context and the approach.

In any case, if beating a person or saying foul language agaiinst one person is a punishable offence, there is no harm in this law, as the objective and affect are the same.

And, there should have some kind of moral policing, even if they don't want to impliment it. If some waste national supporters feel that they can say anything about anybody, they may try it first on their president, prime minister, father, mother, relatives and then may start abusing others.

You are right when you say that if using foul language is a punishable offence under one law, it has to be made punishable under the IT Act too. However, there is the matter of equitable punishment. An abuse verbally expressed attracts a lesser punishment than an abuse over, say an email simply because the former is covered under IPC and the latter under the IT Act which is more draconian. This differentiation in punishment for the same offence is patently unfair.

No - it is Sibal's law, and only Kapil Sibal can be responsible for such a total disregard for the constitutional right of free speech. He has been doing it for quite a while - and I think in the whole UPA administration Sibal is the worst in terms of arrogance. This is Sibal at his best.

We are entering the era of popular dictatorship
by Suresh Bhave on Nov 01, 2012 07:32 PM

The legislators are becoming jittery. We are soon going to enter into era of thought police and close surveillance a la 'Nineteen Eighty Four'. The ministers cannot have a sense of humour, because, though, we the people of India have proved to be extremely tolerant and forgiving despite the worst kinds of frauds perpetrated at our cost by the politicians, the politician is no longer feeling assured of his safety. That is the result of his own pricking conscience. Even now it is not too late to set the things right. All that the politician has to do is clean up his act, be honest, treat common man with respect and earn his respect so that popular opinion expressed on social websites will be full of their praise.

Use of communication device
by Rajendra Sastri on Nov 01, 2012 07:22 PM  | Hide replies

It is not just tweeting or email. Section 66A uses the words "or a communication device". A telephone, either landline or cell phone, is therefore a communication device. You can be arrested and thrown into the clink even if you speak out over the phone.
