Freeze assets
by Guru Prakash on Aug 08, 2011 11:58 AM  | Hide replies

If you want to stop corruption in India, the corrupt persons assets need to be traced, frozen and confiscated. Unless this clause in Jan Lokpal bill is enforced, corrupt persons will not have any deterrence.

The current govt jokepal bill which gives a prison term of 3 months (that too if proven with extra-ordinary evidence after spending crores of public money on investigation) and then the corrupt will be able to enjoy looted money for their life!

People like Raja will not mind being in jail for 10 years (max. period of imprisonment under Govt's version of Lok Pal Bill) and then enjoy thousands of crores of illgotten money.

Real teeth is in confiscation of wealth and levy of at least 100 - 300% (as is the case in Income Tax Act) penalty of the money gained through corruption.

as per many recommended I went through both lokpan and janlokpal bills. clearly janlokpal is more 'inclusive' and has wide range of jurisdiction.

still I would recommend that let the current bill pass. Politicians have not passed Lokpal bill for last 63 years. Due to annaji's fast it is finally passed by cabinet and put on the table of parliament. Politicians are waiting to reject the bill as it anyways includes all the MPs. If Annaji's neew fast give them 'reason' to postpone / reject the bill people will have to wait more years to become this law reality

so let the bill be passed the way govt wants. let the system start rolling. no need to oppose it before it starts rolling

We need an institution which will have the mandate to keep our system clean. Just like we have an institution of judiciary which has the mandate to impart justice, the institution of police to investigate and prosecute, the institution of bureaucracy to run the government, the institution of legislators to make laws, we need an institution which is exclusively work to investigate only corruption cases and keep the system clean and healthy.

Any person aggrieved by any corrupt government official should be able to approach this institution to remedy his grievance. Such an institution is Jan Lok Pal proposed By Anna Hazare. Government’s version of Lok Pal, on the other hand, will not serve this purpose.

this may be true and I am not denying this. I am just saying is this good enough reason to STOP creating ANY anti-corruption law? everyone would agree that current proposed law is better than nothing.

Why should "We, the People of India" surrender to 500 bunch of idiots and give up on what is good for the country?

Why should we not demand from the elected representatives what we deserve?

It's this attitude of resigning to our fate instead of standing up and being counted which is the bane of india.

What i don't like about Govt.'s Lok Pal.
by Vijay Sahani on Aug 08, 2011 11:32 AM  | Hide replies

What I don’t like in Govt Lok pal

1. Selection committee dominated by government nominees
2. Min. 2 years imprisonment for false complaints but 6 months for corrupt official.
3. All bureaucrats not covered by Lok Pal
4. MPs conduct inside parliament not covered
5. Judiciary not covered (This can be waived if Judicial Comm Bill is passed with sufficient teeth).
6. Govt funded NGOs covered by Lok Pal which will distract Lok Pal’s attention away from civil servant’s corruption.
7. PM not included
8. Protection for whistleblower not there
9. Confiscation of wealth and levy of penalty not there.
10. Removal of Lok Pal largely in hands of Government.

Most of the above defects are taken care of in Jan Lok Pal.

All bureaucrats are already covered by respective departments in respective Govt. Top bureaucrats are under CVC and DVAC. No LAW WILL BE SUCCESSFUL UNLESS IT IS IMPLEMENTED FULLY without any deviation. Judicial system should be strengthened as it is very weak now and hence no body bothers. 45 lakhs cases are pending in India of which so many are more than 10 years. Many may be aware that one popular person holding CM position has never attended the court despite so many calls by court for over a period of 15 years. When the court is not respected, do you mean any NEW LAW LIKE LOKPAL, whoever drafted and passed will be successful. Despite death penalty, how many murders are there daily. How many death sentence implemented. Unless there is Fear over the Judgement, nothing is going to happen. About one third of MPS/MLAs are under criminal back grounds. They are also being elected. Who is responsible for that. You and me only. Only a few are crying over lokpal as if it is going to change India, great. Ofcourse, something is better than nothing.

Capital punishment for corruption cases is unwarrented, especially when SC has said it should be given only in rarest of rare cases. Corruption is india is rampant not rare!

However, imo, there is justification for it in cases of corruption at high levels, specially by constitutional authorities, such as corruptio by PM, CJI, EC, etc.
