Some citizen/GC desis are ridiculing H1B desis, forgetting they too were visa holders at some point. Once the H1B holders get GC, they will start ridiculing other newer H1B holders. The cycle continues, typical selfish desi attitude. Grow up guys.

what problems do they cause by comming back to India ? Approximately what percentage of desi's actually come back ? Do you have any idea ?

Well first its not about the money. Guy on H1 pays tax every year but doesn't get any benifits from the goverment.And H1's are getting jobs because american people are not qualified for those jobs. If all H1's are thrown out they'll have to shut down NJTransit for sure!!

yeah because to be elgible for Social Security benefits , you would have to have paid taxes in US for 10 years and the h1b program is for just 6 years

There is where you need Indians. Who saves money and feeds others for free in the name of Security.
H1B folks are not eligible for any benefit from government, that goes to YOU, there is where you need Indians.
You need Indians when there is more amount of work and intelligent work, who doesnt believe in 9-to-5 job and works what ever he gets.

And dont surprise a bit, if yr daughter marries an Indian Origin guy. We will be here for long, and we will stick till end.

That is right. If you are a genuine visa holder who got his visa honestly, nobody will harass you.

All the people who are depending on consultancies to get you jobs in the US, please reconsider and cross-check the reputation of your consultants.

Your short-sightedness and haste not only harm your prospects of being successful in the US but also ruin chances for future applicants.

Consultancies neither care about the people the place nor do they care about India's reputation.

Please exercise caution and sound judgment when you try to go to the US to work.

I was making a general comment about all the people who pin their hopes and dreams on consultants and then have them destroyed by the same consultant's mistakes.

Congrats Vivek.
People are talking about validity of the VISA, you think all the guys came on H1B for the first time, did not have enough docs. There is one very good informative document on the blogs of CyrusMehta. This is a very misinterpreation of the law and bad implementation of the Memo.
I am feeling very pitty for those who came to US and had to return without any fault.
They should not have issued VISA at all if they dont want H1B folks to work as consultant.
India and Indians are gonna suffer a lot because of the Anti-Immigrant policy of Obama.
I was expecting someone from Indian Government to speak up on this subject, but they are busy with their own politics.
They dont care if half of Kashmir is shown in Pakistan & China or Prices of necessary things are sky high.
What are the Indians working with Obama doing ? Why did they not raise any question ?
I will support anyone who will oppose such humiliated efforts to stop Indian H1B workers.

Even they issued a visa, simply can amend another rule that Issued visa for H1 is no more valid. Why they are not doing that. Bcuz these gora loog wanted money and unnecessary that guy or his company have to spend... why???

As Rahul said if you have all the important docs such as pay stubs,w2 etc and can answer all the questions confidently I see no reason for sending you back from POE. I think its only happening for fresh H1's and some black listed desi companies.

This is good news as it elimintates the fraud resumes and also eliminates the lower billing. These fraud and blood sucking consulting firms made the IT market as a fruit/vegetable market. Now a days when these comapnies call, they talk billing in the range of $20 or max $30 or $433 per hour.
Most of the indian consultants are taking advanatge of american laws and are making money illegally. These consultants are ready to take any offer and are also instrumental in bringing down the billing rates. I saw lot of people working in the companies with fake resumes and with lower billing. This law will eliminate all these fakers and also the dirty companies.
Also US Govt needs to look into the fakers who are hurting the people having real experience. US Gov needs to ban these people(having fake experience) and also the companies encouraging these fake resumes.

I think that wont be possible to eliminate "middle" guy. Look at the number of counsultant companies and manpower they have. Eliminating middle vendor will drastically bring down the number of people working.
Best way is the verify the authenticity of the people working with companies. Its tough, long and expensive. But its rather good than harrasing genuine people working here for long term.
If you are complaining about lesser rates, you have to be more competent. There are many comapnies with good rates around. And even if that is the case I will rather take 5-10$ less if that accomodates one more Indian in US.

There has to be big gathering in front of white house again like many immigration forumns do.
Join them, support them.
Not doing anything, blaming others and keep on whining, will not help anyone.

The US government should ban visa applications from these fraud committing consultancies.

They should make the company where the applicant is going to work file all the visa application paper work directly.

This is one place where eliminating the middle man will do an unlimited amount of good for the current and future candidates!

this news is a bit confusing. No big IT firms in INDIA has raised any alarm, so I assume it does NOT affect the majority of cases

can some one please give an example ( using example companies A , B C etc )

of how this rule will affect the existing H1B workers and what is the scenario that is going to be affected

raj, this action has been taken to curb fraud by "consultancies" who fill job openings with candidates who are neither qualified nor experienced for the work they are hired for.

This is a stop gap move till the US government figures out a way to outwit these fraudsters who are mainly Telugu and Gujarati people.

Mind you typecasting these fraudsters to telugu and gujarathi, i have seen people from delhi, mumbai, tamilnadu, karnataka.... doing it too..

Don't feel ashamed to term it as Fraud Indian consultancy companies.

On the other side, there is supply only to meet the demand. Why do these companies have requirement for experienced professionals?. If a person with fake resume gets that job, how is he/she sticking to it?..He/she is getting the job done rite?... What happens if they don't find these people in time...Think about it.

I am a Telugu and a fulltime.

I personally feel all the consultancies should be removed, but this doesn't solve the problem.

Raj - I believe this is how it's going to work. This applies for new H1s or for H1 extensions.
If you work for companies like TCS,CTS,Wirpo etc, you don;t have any issue because these companies work directly for client.
But if you came through the layers of consulting firms, then it will be a problem.

There are 100s of scenarios where these so called big IT Companies work under layers.
So it does not matter. For lot of clients TCS , WIPRO , INFY etc are in 3rd layer under Comsys or Unisys or etc
