CJI impeachment and relief
by Pushpakaran Thiyadi on May 08, 2018 08:35 PM  | Hide replies

It is all humbug. It is to be seen that the four-five judges who went public on judiciary, would have been penalised for going public on internal issues. In fact, the way Mr.Kapil Sibal and party prefered the above judges to hear many cases simply means that they are in cohort with each other. The judges who went public are the puppets of the opposition. They wanted just to threaten the judiciary via CJI impeachment for their own goods through failure of bench fixing .
Unfortunate state of affairs!

As if CJ was worried about these comedians. Even the black sheets in judiciary taking order from congress and left could not harm him except shout T the top of the voice

The communists are rejected almost everywhere in this country for last 70 years. They are aware that they have absolutely no scope to come to power at the center. This people want to controleducational institutions and jinfluence judiciary. The people of this country should keep a watch on their activities and must not allow them to succeed in their mission.

The headline of this article reads, Relief for CJI, since Congress recalled its petition.

The news actually is the Supreme Court rejected it outright , which lead to the petition being pulled out.

This is how Rediff plays around with words to bluff & fool people

It was stupidity to file petition challenging decision of Chairman of Rajya Sabha ignoring powers vested to the Chairman, Rajya Sabha to conduct the business of the house. They also forgot that as per article of 122 (2) , no courts of law has any jurisdiction to challenge his decision as per the power vested to himby the constitution. Both Sibal and mischievous Prashant Bhushan must be aware of this, however, they are only interested in playing dirty politics only. Prashant Bhushan wanted the bench headed by his favourite Justice Chelameshwar to hear the matter. Now he want to know who constituted the five members bench and want to challenge this also. This will continue till Justice Dipak Mishra retire on 2nd October, 2018. Meanwhile, the leader of Gang of Four judges who staged revolt against CJI will retire next month and Justice Kurian Joseph and Justice Lokur by the end of this year. Do Prashant Bhushan has common sense that if Justice Mishra can not be part of five member bench to hear petition against him, how the four judges who are totally bias against CJI can be allowed to be a part of five members bench. Now I feel, Kejriwal was totally right ion throwing out Prashant Bhushan from AAP. This man , who was badly assaulted in his chamber in Supreme Court but didn’t do anything or had filed any complaints against the assailants but is more interested in fighting fior others.

When CJI asked Sibals to mind his tone during the argument on delaying Ayodya hearing, this is the revenge Sibal took. It is loud and clear what Congress stands for and how rediff portrays it to public.

Why Kapil Sibal wants to know who constituted the bench for hearing the impeachment petition? When he was a Congress minister whether he used to get involved in such things? Hope Congress will not write its own obituary by trying to dictate the judiciary.

If the CJI himself sets up the bench to hear the case that involves his impeachment, then there is a conflict of interest. That is why who constituted the bench becomes important.

Then why withdrawal of petition? They could have ascertained and then withdrew. My question is why he should interfere in the process of law

Sibal consider himself to be a senior counsel but could not quash complaints against Gandhi’s and others in case filed by Dr Swamy in National Herald case.Dr Swamy is not a lawyer practicing in Higher courts but he argued his case successfully against both Abhishek Manu Singhavi and Kapil Sibal and did not allow them to succeed in quashing the complaints.

Point 1: CJI is the master of roster
Point 2: 5 judges went against CJI can not be trusted that they will be unbiased against the person whom they revolted.
Point 3: CJI himself not part of the 5 judge bench constituted.

So where is the conflict unless you want what Sibal also want; ie., one of those judges who revolted against CJI, be part of panel.

Clear mind, think it with clear mind. Every one has seen the behaviour of four senior judges who called press conference during the court’s working hours, without prior intimation to the head of Judiciary to stage revolt against him. As per common knowledge, if CJI can not be part of five members bench , so do the four senior judges . Whoever constituted the bench has not done any random selection but gave job to hear the matter to next senior judges after this four most senior judges. However, as per three members bench decision delivered in April, 2018’ the judges are treated equally and none of the judges are designated as senior judges or junior judges. Let Prashant Bhushan, the mischievous counsel put all his futile efforts to impeach CJI till he complete his age of superannuation on2nd October, 2018 and retire as CJI after completing his full term.
