Kapil Sibal

Why Kapil Sibal wants to know who constituted the bench for hearing the impeachment petition? When he was a Congress minister whether he used to get involved in such things? Hope Congress will not write its own obituary by trying to dictate the judiciary.

If the CJI himself sets up the bench to hear the case that involves his impeachment, then there is a conflict of interest. That is why who constituted the bench becomes important.

Then why withdrawal of petition? They could have ascertained and then withdrew. My question is why he should interfere in the process of law

Sibal consider himself to be a senior counsel but could not quash complaints against Gandhi’s and others in case filed by Dr Swamy in National Herald case.Dr Swamy is not a lawyer practicing in Higher courts but he argued his case successfully against both Abhishek Manu Singhavi and Kapil Sibal and did not allow them to succeed in quashing the complaints.

Point 1: CJI is the master of roster
Point 2: 5 judges went against CJI can not be trusted that they will be unbiased against the person whom they revolted.
Point 3: CJI himself not part of the 5 judge bench constituted.

So where is the conflict unless you want what Sibal also want; ie., one of those judges who revolted against CJI, be part of panel.

Whoever has constituted five members bench played a master stroke which compelled the petitioners to withdraw the petition.

Clear mind, think it with clear mind. Every one has seen the behaviour of four senior judges who called press conference during the court’s working hours, without prior intimation to the head of Judiciary to stage revolt against him. As per common knowledge, if CJI can not be part of five members bench , so do the four senior judges . Whoever constituted the bench has not done any random selection but gave job to hear the matter to next senior judges after this four most senior judges. However, as per three members bench decision delivered in April, 2018’ the judges are treated equally and none of the judges are designated as senior judges or junior judges. Let Prashant Bhushan, the mischievous counsel put all his futile efforts to impeach CJI till he complete his age of superannuation on2nd October, 2018 and retire as CJI after completing his full term.

Congress is playing a dirty game, they have been playing earlier too, biggest bankruptcy is that congress does not have a leader, their leader is not considered a serious leader by people of India. As such no alternate to BJP in sight.
All others are local caste based or region based parties and they are basically extortionists.

Impeachment case
by babukmenon on May 08, 2018 03:18 PM  | Hide replies

kapil sibal was expecting one of his agent (the 4 judges who are agents of the kichadi coalition) in the bench so that he can humiliate the central govt, Judiciary, SC, CJI etc. But it was wisely stopped by the judiciary. Now the 4 stooges, sibal and similar others should stop Law practice and can join the street bandwagon of the kicahdi coalition, which will always be rejected by the Indian public. No more cheats. Jai Hind.

I dont understand why Congress party is hiring the services of Kapil Sibal and Abhishek Manu Singhavi to handle their matters. Kapil Sibal and Singhavi could not quash the complaint against gandhis and others in case of national Herald case against Dr Swamy who successfully argued his case while both Sibal and Singhavi miserably failed. Do Kapil Sibal was expecting their petition to be heard by that famous four senior judges ? Why other mischievous counsel Prashant bhushan mentioned about urgent hearing of the case before the bench headed by Justice Chelameshwar ? All senior eminent counsels like Soli Sorabji, Fali Nariman,Harish Salve, Jethmalni has confirmed that decision of Venkata Naydu was correct, there was no point in filing petition challenging his decision. Fortunately, knowing very well that they have no chance to succeed before Apex court, the petitioners has withdrawn their petition .

CONG NEXUS: Pravinqp: After a continuous hearing of 17 long years River Cauvery dispute between TN & Karnataka - Judgement was accorded on 16.2.18 to Centre to formulate a SCHENE within 6 weeks time - ended on 29th Mar 2018. On the expiry date Central Govt sought clarification about the word 'SCHEME' and sought time. Time was given till 3rd May. But the govt sought time for the reason could not get approval as the ministers concerned are on election campaign in Karnataka. Supreme expressed dissatisfaction but given time upto 8.5.18 (and ordered for the release of 4 TMC water to TN.) Again the govt made a plea and the Court accorded permission till 15.5.18. What does it reveal? Whom should we to blame? - What is the interest shown on TN people when they starve for drinking water
