Article 35A wasnot added to the Constitution by following procedure prescribed for amendment of the Constitution of India under Article 368. Article 370 doesnt anywhere confer on the President legislative or executive powers so vast that he can amend the Constitution or perform function of Parliament. It has been brought about by the executive organ when actually right of amendment of the Constitution lies with legislative organ. Therefore it is allegedly ultra vires the basic structure of the Constitution since it violates the Constitutional procedures established by law. Besides carrying out many modifications & changes, this order added a new Article 35A to the Constitution of India. Addition or deletion of an Article amounted to an amendment to the Constitution which could be done only by Parliament as per procedure laid down in Article 368. But Article 35A was never presented before Parliament meaning the President had bypassed Parliament in this order to add Article 35A. The PRC classification created by Article 35A suffers from the violation of Article 14, Equality before the Law. The non-resident Indian citizens cannot have the rights & privileges, same as permanent residents of J&K. This also meant that amending power of Parliament under Article 368 of the Constitution itself was abridged in its application to J&K, another amendment without any reference to Parliament. Kashmir is integral part of India, but hate should not work,targeting perticular community in India is there since present govt should not able to stop its supporters.we should win the people with love and respect, The azad kashmir which is pakistan occupied, people have separate constitution, parlment and prime minister ship, they have full freedom, why indians cannot think that way, give them full freedom with love, good jobs, decent living, before that stop all sort of voilence, then it will be like indian switzerland, It will create wealth to india, but some sect of people dont understand this.

which fool told you azad kashmiris have full freedom ? to stand in election you need to be approved by ISI/Army ? Is that your idea of democracy or freedom ? In jobs non kashmiris are preferred in Azad kashmir. in indian J&K they have too much freedom, that is the problem As for 35A , if they want it then no kashmiri shud have right to own property in rest of india. OK ?

The people of kashmir needs to understand that if other indians start living in kashmir there will be a sense of love for india and national anthem. The state become isolated and they are still thinking in the lines of 1947 partition. shame on the both state and central govt for not creating awareness among the kashmiris people

gone are the days. Kashmiris should understand that they ate integral part of india and shamelessly enjoying tax payers money in the name of article 370 and 35A. shame on the people who are supporting in this issue.if i can abuse these people through this forum i will be more happy.
