Loya verdict: 'Important facts remain unanswered'

In our country the criminal justice system failed because we adopted the adversarial system of the British. (Two lawyers fight it out in the court presenting facts favourable to their respective clients). The case is often decided in favour of the party having the better lawyer. In India the system is particularly messy, with cases dragging on for years, judges retire or die, witnesses testify long after the memory had faded, turn hostile or leave the planet before being called by the court.
In France an inquisitive system is followed where the police place all the facts before a judge. The judge will not try to find an accused guilty or innocent but examine all the facts (with the help of lawyers) and try to arrive at the truth.

what a farce... so you mean to say Judiciary system in India doesn't follow the facts ,,, doesn't check and verify evidences... are you in senses?

Your faith the Indian judicial system is touching, a system which is condemned as a failure by Indian jurists. As far as verifying evidence and checking facts try to recall the cases of "Kissa Kursi ka, Jabalpur ADM case during the emergency, Justice Kudal's inquiries, Kehar Singh's conviction. Do you think the acquittals in the recent riot cases, Syed Modi murder and Bangalore pub case are based on verifying the evidence or because the accused had stronger counsel? The acquittals or convictions in the cases I mentioned are a result of the adversarial system. Please think over before questioning me about my sense.

It makes this website even more foolish when the known truth of the judge having died of heart attack is accepted by many based on witnesses...

Is it for lulling the masses or for awakening? There is a pattern in all the recent acquittals. Is it not the duty of the press to analyse and pursue? There cannot be closure to a case with the acquittal of the accused. Attempts should be made to identify the real culprits and punish them.

there is a a very strong back ground in this case. for the sake of the very existence of India the judiciary should remain independent. but here CJI himself under scrutiny. the investigation needs to be conducted for the sake of justice.

First of all criminal proceedings should be instituted against Caravan, Congressis, Gang of Four Sc judges, Congressi funded Lawyers like Dave, Indira Jaisingh and company

what will expect from RSS/BJP in each matter. every one along with you know the truth how Justice Loya under pressure and why. this simple logic you dont know and blaming to opposition. while showing the finger to other dont forget balance four finger is showing you. this is court to decide snicerely and not you and me. Please keep this mind. when you are telling these people should criminal proceeding then any one can understand about your mentality if this is going on no time we will be again raj and gulam. raja said gulam heard. any way this is democratic country what international people thinking about our judicieay will come either today or tomorrow then we will realize what price we have paid.

Here CJI is under scrutiny from fellow judges. and the verdict affirms the possibility of manipulation as indicated by other judges. so for the sake of the people of India the truth must come out. Shah or Gandhi does not matter. our future is at stake. we need to see to the end.

To Reform & Develop India, hang 1 lac criminals / yr for 10 yrs

Just like credit rating, there should be criminality rating for each state. Quotas of criminals who should be shot should be set for each state according to its population.

All rapists, robbers, mobile phone-snatches, laptop-snatches, chain snatches, corrupt gov officials (who amass over Rs 1 cr), etc should be shot.

It should be made mandatory to hang or shoot 100,000 criminals pan-India every yr (70,000 North Indians, 20,000 South Indians, 10000 East Indians). Every day, at least 70 criminals (25,000 per yr including Jats, Yadavs, Gujjars, IzlamicCriminals, etc) should be hanged in Delh-NCR (including Noida and Ghaziabad) and Haryana every day.

Then nationwide, 25 politicians (including present and former MLAs, MPs, etc and their sons) should be shot every day.
