Bail, not jail, is a dominant principle of criminal law practiced by every mature democracy and in India often in its breach. Be it A Raja or Kanimozhi in the 2G case, Suresh Kalmadi in the CWG case or Asaram, facing an unproven sexual assault charge, once a case becomes high profile courts are diffident to grant bail even if that flies against the express directive of the Supreme Court. Finally bail will be given by Supreme court and the matter will be heard by the lower courts and finally it will go in appeal. It is surprising that most of them are not aware of laws. It is a few who try to create a sensation.

The lower court did not wait for mandatory time allowed to the person declared found guilty as stipulated by the Hon'ble Supreme Court. However, in High Court, her case was adjourned compelling her stay in jail for few days more. In both ways Jailalitha has been forced to suffer. it could have been aavoided.

Ha Ha Ha. You have got a good humour sense. After sheer mockery of the whole judicial process by Jaya and Company, now they are relying on technicalities to wriggle them out of this verdict. This is a peculiar case where it dragged for 18 long years. The accused were indeed given sufficient time to explain their point in the end and then the judge pronounced the date of verdict. But even there, Jaya and Company tried every trick in the book to postpone it under some pretext or other citing security, law and order etc. Even on the 26th Sep, we had a petition at the Supreme Court to stay the verdict. Such was the way the whole judicial process became a laughing stock by the diabolical manoevures of Jaya and Company.

Both dravidian parties fooled TN people exploiting sentiments of language and culture,showing Hindi as a ghost.utter nonsense,better TN people look alternatives.Aryan and Dravidian words are propagated by British to suit their policy of divide and rule.There are neither Aryans nor dravidians.

The whole problem lies at the doorsteps of our judicial system. The old adage "Justice delayed is justice denied" holds good at this point. If only this case had concluded within 3-4 years, then most of the suspicions that are being raised at this point of time would surely not have arised. The current generation are obviously not aware of the intolerable excesses commited by Jaya and Company between 1991-1996 literally taking the State for a ride. Unfortunately, due to the public short memory, she got reelected in 2001 and just used her political influence to overturn the corruption cases against her. She also through her numerous petitions and appeals just delayed this case inordinately knowing well that it was a water tight case where she had little headway. She did try to subvert this case too when it was conducted in Tamil Nadu through her abuse of power. It is for this reason, the Supreme Court transferred this case to Karnataka then. The Rs. 248 crore London Hotel case too was detached from this case since it was considered unviable to gather evidence to book the accused.If only it had been clubbed along with this case, it would still taken another 10 years to yield a verdict. Such is the speed with which our judiciary functions.

It was mandatory to declare punishment after declaration of finding guilty, however, that was not allowed in her case. Now the High Court judge adjourns hearing by which mental trauma of the victim will persist. this could have been avoided.

Hey man, this case just went for 18 long years and the accused were being given with every liberty, privilege that normally denied to even other celebrities forget the commoners.

After creating 33 Million Pantheons to worship, Indians (Tamilians) obviously are not mentally satisfied and still they crave for more and more deities. Yeh Dil Maange more is the Desi's (Tamilian) eternal desire ? What they do ? They start deifying some politicians and build a personality cult around them. They idolize them with sheer blind devotion that they become immune to their malfeasance/misdemenaours and then begun to defend their meanest acts by forwarding warped logic and strange arguments to defend their indefensible position. This disease is not limited to the illiterates but also the so-called educated who are even more unreasonable. Just see the extent of spontaneous outpouring of sentiments and emotions running high after Jaya was extended an adverse verdict after 18 long years. People came to the streets, shops and establishments shut, Old and middle women crying, girls commiting suicide, boys wailing, buses being burnt (thankfully we didn't see a repeat of Dharmapuri). The whole State of Tamil Nadu engulfed in a despondent and melancholy mood on seeing their Amma being convicted and incarcerated. They just target their political rivals and see that as their diabolicial act in implicating their Amma in the case totally forgetting that their Amma was indeed in the saddle as CM for over 10 of the 18 years when the case just stretched without cease due to the delaying tactics of their Amma.

Mr.borowiack,the points stated by you is correct except one statement where you said there was spontaneous outpouring of sentiments by tamilians.Not entire tamilians are in the category you said.All emotions and demonstrations in tamilnadu are set ups and arranged.Set up people came to streets.Shops and establishments were shut out of fear of damage by rowdy elements.Old and middle woman crying for being paid.Girls commiting suicide on their personal reasons which was coloured and linked to this.Buses were burnt by rowdy elements.Pl.note that the general public is totally isolated and quite.The state govt tacitly supported all atrocities.

Another important point is her (JJ) life was spoiled by a short uglydog MGR, a keralite fellow who cheated poor TN people and ruled TN for 14 years without a single development in the state. How a prisoner will get BAIL with out any valid reasons?
" Section 389 states that pending any appeal by a convicted person, the Appellate Court may order that the execution of the sentence or order appealed against be suspended. Also, if the person is in confinement, that he or she be released on bail, or on own bond"

All Prisoners should apply for BAIL on SINGLE day then all can be released on BAIL

It is the Supreme Court of this Country which was not able to tolerate the abuse of power exercised by Jaya and Company to subvert the verdict in this particular case wherein her Government changed public prosecutors at will, replaced investigating persons and also put pressures on witnesses to retract their confessions. The Judge here taking cue from Jayalalitha didn't even enforce perjury charges on them. And so this was taken to the Supreme Court which transferred the case to Karnataka and it is not new. And the Supreme Court deserves such abuses too considering the way they delivered the TANSI judgement severely indicting her by even demanding her to return the TANSI land but strangely left her scot free making a mockery of the verdict.

The Special Court has found her and accomplices guilty. Unless this is set aside by a Higher court, she remains guilty and a criminal sentenced for corruption.
