It's loss not victory
by shyam patel on Aug 07, 2009 03:02 PM  | Hide replies

Women misusing 498A eventually loose respect which is foremost important for them. A wife who loose respect in her husband eye will never earn respect in their parents and her children as well.

She definitely win the legal battle but by loosing the war of getting respect in society.

Fact about law: 'You will always find law to break the HOME but never find law which can connect the relations'.

You are right man. What you sow is what you reap. Modern women fail to understand this. How they treat their family, is the same way they get treated by their children and daughter/son-in-law. God's law cannot be biased. Truth prevails.

This is a classic case of Govt intervening into family. If families are nationalised, Govt will be privatised.

Much of Govt functions privatised in western countries like US. The nincompoop judge is setting bad precedent.

One silver lining is it is not SC but one of many lower courts whose judgements can utmost influence other courts and not impose.

I don't understand the euality of men and women
by Dhananjay Kumar on Aug 07, 2009 02:39 PM  | Hide replies

If men and women are equal, then

Daughter in law is equal to Son in law. If a son-in-law can be kicked and no body will even care, then why this bruhaha over kicking of daughter in law.

Women in India, especially the modern ones, must start taking the equality both in terms of benefits and disadvantages. But they won't. They are born like that only. That is why our ancestors in all religions chose to discipline them by imposing certain rules. Those were good for a balanced society. If those rules are demolished, we moving to the human civilization dooms day.

Hello..does in your home people kick son in laws...I hav enever heard that in any Indian home. People just pamper their son in laws while their daughters get kick at his home. Women has not yet got even 5 % equality. Still it is a patrarchial society where D-I-Ls have to go and tolerate all the in-laws while men just enjoy the comfort of his home and family. First bring 100% equality...but men just fear that and therefore they want to keep all the existing rules so that they can enjoy the comfort they are enjoying since centuries. You are a moron just like your ancestors.

and teach them discipline. Don't be afraid of going to jail. If our freedom fighters were afraid of it, we would have never got freedom. Start puni shing your wife who throws trantrums and threatens with 498A. If possible ki ll them, after recording some instance of her actual behavior. Then only the govt and law will wake up and demolish 498A. Accroding to chankaya - wife understands the language of stick. I am sure he was talking about this modern era only.

I pity the lady who married or will marry you. If you hate your wife or D-I-L better leave her. You have no right to torture anyone. A D-I-L will behave exactly how the in laws behaves to her. As you sow so shall you reap. Better both families should kill each other and help the society to get rid of such morons.

The real morons are people like you who support the misuse of laws by women as a right of women. You do not know what IPC 498A is until it comes and sticks up your back! So, don't make stupid comments. If you want to taste 498A, I can ask some lady who has already done it to file it against you. Want to taste it?

Real cause of filing a 498a, someone wants the girl as a keep.
by Pranab M on Aug 07, 2009 02:17 PM

Real cause of filing a 498a, someone wants the girl as a keep.

1. A brother in law who wants to take sister in law as a keep
2. Ex lover got married but wants to take his ex girl friend as a keep
3. Some uncle/brother/nephew wants to take the girl as a keep

So they force the girls to file a 498a case and grab good amount of wealth , so that the person can enjoy some one else's hard earned money and the body of the girl

Anyone getting slapped a 498a , just use a hidden camera to prove one of the above facts and file a c r i m i n a l case against that person , in a day the girl will loose the courage to come to court.

KNow the full facts before commenting on judgement
by Ravinder Singh on Aug 07, 2009 02:05 PM  | Hide replies

We don't the full facts and passing comments on SC.... SC has been very harsh in past in such cases,,,, but why in this case...there must be some strong facts to do it... I can tell you my story....I married a lawyer one & a half years ago,, I married without taking a single penny in dowry and also we went just 9 family members. Afte some time she started throwing tantrums and threatening us with implicating in dowry law... Her parents are apologetic about her behaviour ,,,,, She said sorry infront of them and then after sometimes she is same.... Its like hell talking to her... What will you say in these facts.....I have cut short the facts,,,, though her language is so bad some times I have never heard someone speak such derogatory remarks... So don't say SC is wrong without knowing the full facts.... In this case also the Daughter--in-law dragged them to court and also wants to be with in-lwas..... How come????? Something fishy with her beahviour.

I feel sorry for you. But you know since centuries women have been and are still being oppressed in our patrarchial society. Atleast rules like give women some relief from unjust behaviour of in-laws. I know the misuse can be torturous for many families. But either you let women be tortured or opposite. Why not help women who are actually being tortured against some cases of misuse. WHile stilly there are many women who are tortured but never use that law. Rules and LAws are like that...when since centuried they are used to oppress women it was fine...but now when women are being given only few liberties men are making such a loud roar.

Patriarchy is a term invented by feminists. They gave a bad name to it and educated people like you haven't questioned it. The fact is that the feminists sleep with patriarchy and whip it during day! They want to take the advantages of both systems. If women were oppressed for centuries, men were oppressed for much longer. Men had to do more difficult jobs and more dangerous jobs to feed women and protect them. This fact has been suppressed by feminists. BTW, you seem to suggest that men have no rights and that it is better to torture men than to torture women. It shows that you are in favour of women and not neutral.

This is becoming too much, who are parents anyways?
by Argumentative Indian on Aug 07, 2009 01:07 PM  | Hide replies

What just because these people give birth to us, feed us, clean our poop when we don't know any better, educate us, they think they can start expecting decent behaviour from us??

What's going on here?

Isn't it the MIL's job to do the cooking, cleaning, wahsing, scrubbing, after all the Bahu is an 'earning' member.
So what if the Bahu is earning essentially for herself, the household is run on the earnings of the son?

And what is so wrong if these old foggies are sent to jail once in a while on trumped up charges - say dowry cases, or mental / physical cruelty, after all a young couple needs privacy sometime and not every one can afford expensive vacations always.

I think In Laws really need to rethink their demands.

Though cooking , cleaning etc is not MILs job but its not even only D-I-Ls job it should be joint effort with male members also included, who in most of the indian houses sit and do nothing. If bahu is earning she can contribute her husband but why to MIL-FIL...isnt its her parents who educated her but FIL, MIL enjoy her earnings directly or indirectly. Their son can afford to lavishly spend on them because he is having his wife's savings for children. Why not talk about 100% equality. Where daughters can take care of her parents like sons do for his parents. And not bahus have to tolerate the in laws but jamayis also have to stay with in-laws and tolerate all their tantrums and taunts...old foggies shouldn't be sent to jail but atleast should be in their limit and give space to son's family and bahu especialy...and keep their special advices with them...

If we talk about 100% equality, women will have to guard the border against Pakistan, fight terrorists, give alimony to men, maintenance to men and we need to have gender neutral laws. You want women to take advantages of tradition and modernity is it not? Thats not acceptable.

OMG Aren't all the worthies Joru Ka Ghulam?
by Argumentative Indian on Aug 07, 2009 01:00 PM

Difference of Opinion at the highest levels?
What's happening?

Just the other day another panel of the same hallowed institution had proclaimed that one has to agree to the wife, always, as they are also doing themselves!

Anyway, in that case, the defendant, i.e. the D-I-L had merely implicated her Inlaws in a couple of false cruelty cases, what's wrong if the old MIL / FIL go to jail for a while on trumped up charges?
