Staying in wife's house?Claim HRA rebate

If an employee pays house rent Rs. 9500/- per month and he is getting basic salary Rs. 360000/- and HRA Rs. 100000/- per month can take HRA benefit in Income Tax?

Hello friends,
I'm paying Rs 8000 as house rent. Actually the problem is i didn't declare house rent in FBP declaration form of company.And i came to know about this thing in last month of closing financial year of 2007.And i have paid 12000 as income tax already.

My question is how i can take return back this money from IT department. One important thing is that HRA is the component of my company salary structure.
Please help me out regarding this money return back.

In the month of june or july when you file your income tax return, you can submit the rental receipts and make the calculations for HRA.The excess tax what you have paid(after calculations of HRA) will be refunded to you by Income tax department.However it takes quite a long process to get back refund.So dont forget to submit the rent in FBP declarations from the next month.

Non-filing of IT Return

I had last filed my IT return for the accessment year 1999-2000. After that till the previous year 2003-2004 I had no income. I started doing job since 2004-2005. IT had been deducetd at source since then. But during 2004 - 2008, I have changed 5 companies and never filed a return. I was however, carrying on the LIC policies, NSC etc. Now for the accessment year 2008-2009, I want to file the return. Kindly guide me the procedures.

Claiming rebate on Housing Loan.

The House is in the name of my mother.But,the House loan of Rs.3 lacs is taken jointly by me and my mother.Myself is the primary applicant.
My office told that you can't claim rebate on this type of House Building Loan.Is this true?

Some of our friend suggested you can not show such amount .

dear mr.vikas,
myself dr.divyesh goswami working in autonomus government grant aid organisation & earn as per gov.class 1 officer.my wife is working as class 1 officer in govt.medical college.we both live in house that she got from govt,she pays for it.
HOW should i claim my HRA tax free?i get 2300 rupees as HRA every month???

Hi, Mr Vikas,
We purchased a plot jointly with my wife in the year 1985 .We built the house after availing Bank loan during 1986 Thus Me and my wife are co-owner of the house & we are residing in it . My wife is collecting rent from my daughter-in-law who is gainfully employed .Myself my wife and my Son's family, we all are residing in the same house . A part of the first floor is also let out to out siders . My wife has got a PAN N0. The rent amount thus declared by the tenants , including my daughter in law works out to be approx. Rs 135000/-. GF of the house was built in 1986 and the FF during 1993 . I am claiming rebate under section 80-c for repayment of the housing loan . My wife used to file I Tax return previously showing FF as rented .My son and daughter in law have joined us onlt two years back after getting their posting at this place . My wife has not filed any Income Tax return for the last two years as the income of rent collected is less than Rs. 145000/- . Please let me know if this is in order.
