Section 49-O of the Constitution of INDIA .
by tadphan on Apr 15, 2008 12:07 PM  | Hide replies

Did you know that there is a system in our constitution, as
per the 1969 act, in section "49-O" that a person can go to the polling

booth, confirm his identity, get his finger marked and convey the presiding
election officer that he doesn't want to vote anyone!

Yes such a feature is available, but obviously these seemingly
notorious leaders have never disclosed it. This is called "49-O".

Why should you go and say "I VOTE NOBODY"... because, in a ward, if a
candidate wins, say by 123 votes, and that particular ward has
received "49-O" votes more than 123, then that polling will be
cancelled and will have to be re-polled. Not only that, but the
candidature of the contestants will be removed and they cannot contest
the re-polling, since people had already expressed their decision on
them.
This would bring fear into parties and hence look for genuine
candidates for their parties for election. This would change the way,
of our whole political system... it is seemingly surprising why the
election commission has not revealed such a feature to the public....
Please spread this news to as many as you know... Seems to be a
wonderful weapon against corrupt parties in India... show your power,
expressing your desire not to vote for anybody, is even more powerful
than voting... so don't miss your chance.
So either vote, or vote not to vote (vote 49-O) and pass this info
on...

"Please forward this "LAW" to as many as possible, so that we, the
people of India, can really use this power t

PUBLIC LOOT

A very revealing article which should be circulated not only among the elite and intelligential but amongst the common under privileged and downtrodden masses with whose votes these corrupt politicians thrive. Unfortunately, the democracy gives only one route to power that is throught he ballot boxes where the people using their franchise are misled and divided and left with no alternative. As rightly said that IS HAMAM ME SABHI NANGE HAIN, it is the NIYAT ME KHOT which is helping the loot to sustain and survive. The only solution is national awakening. -- dip

It is the most serious issue confronting the nation ans is the root cause of all the ills afflicting the people and the Nation. However when people themselves become a party, aquiesce or indifferent to promote such a catastrophic anti-national activity then it assumes the form of National Character and ethos.Look around and you find glamour, glitz and entertainment gets national coverage, importance and their participants and promoters the status of legends and celebrities. What is the state of teachers, professors, scientists, technologists, other intellectuals, honest industrialists, businessmen and the armed forces who collectively form the backbone of this nation and have so far provided sustained peace, security, progress and growth untill now.We have become a downright disgraceful commercial people without any self esteem, pride or honour. Every street dancer, singer or half clad model is lauded and bestowed with honorofic titles. In this state of chyrocratic and hedonistic immoral degradation a State can only decline as it always has. History bears ample testimony and indeed is only repeating itself. We are now at cross roads and living in the most crucial period of our national history. We either stand together for principles and rebel against the present establishment to save this country from a total collapse or remain a byestander watching it slip into chaos and anarchy to be taken over by some other imperialist power like China.

Who can bell the cat?
Of course you, me and all Indians.
The first step is that all must vote. Because majority of Indians do not exercise their right to vote, we get the most corrupt and crooked politicians whose ONLY aim is to LOOT the country.

We can write a public petition and send it to the President of each nation that is a Tax Haven asking them if they would rather that the poor people in India starve while the money that could help them in the way of taxes is parked in the banks of their nations!

well according to the article, these nations are ready to share info, but indian politicians will not let that happen. From the article "In contrast, in India every political party knows that it cannot accuse the other of being corrupt for the fear of being becoming the target itself. Hence, there is an unwritten truce between political parties not to charge the other of being corrupt."

The writer of the Article is correct in that India should do something. Mr. Chidambram should take note and ask the RBI and the Tax Authorities to file an immediate request with the Swiss Authorities to reveal the details of the Bank Accounts of all persons of Indian Origin. These Indian Authorities should then take the appropriate steps to question the concerned individuals about the source of their money. It is not necessary to carry out a public trial. It would be sufficient to bring to trial the persons who are genuinely at fault.

That's so sweet of you. But Swiss law doesn't allow disclosure of identity of account holders as not paying taxes is not consideres a crime in switzerland.

I believe that you are wrong. If Swiss people themselves do not pay taxes it would be very difficult to run the Nation indeed! What you are getting confused about much as the article indicates is that the Swiss Banks are discreet. They do not inquire about the source of the funds deposited with them. Neither do they announce publicly the names of account holders and the money that they have deposited. However requests through proper channels are always taken up. Since Switzerland was neutral during the World War a lot of Nazi Era officials of Germany deposited their ill gotten wealth in Swiss Banks. Some of it is still there. If the antecedents of these account holders could be determined a proper investigation can be taken up.
