Builder insisting to pay 20% first and thn registered doc.

Request for your help.

I have purchased underconstruction flat @ Borivali East, possession will be after 2 years.

I have already paid 15% of my Flat value and I have informed that balance 5% I will pay alongwith bank Loan on prorata basis. Bank have already sanctioned (in-principle) 80% of Flat value.

But the builder is saying, as per new rule of MOFA act, buyer have to pay 20% first and then only he can go for Bank Loan. My Bank is ready to disburse / sanction loan without paying full 20% by me.

Is there is any such rule in MOFA saying that we have pay 20% to get loan or to register agreement ?

I had booked a flat on May 2005. After so much delay builder is going to give posession letter on jan 2011. But the builder is asking additional amount as the area has been increased. as per the agreement area of flat is 1225sq.ft (approx)and the price of the said apartment is 17,51,750/-

Builder Buyer Agreement

I have booked a flat in June 2010. Now the builder doesn't want to sign for the Builder Buyer Agreement and instead signing a Term and condition document and bank is disbursing on the basis of that along with Permission to mortgage and Tripartite agreement. Please advise what do I do as I have already paid 10% and what are my rights with regards to builder buyer agreement. What should I do?

Cancellation charges

Need advice, I have booked a flat inPune, with one of the reputed builders, and would like to cancel the agreement, I have till date paid around Rs.1000K towards the agreement which is registered. The builder is now claiming 10% cancellation charges towards the agreement value. Please advice.

Builder sold a flat with car parking.This buyer not parking in his slot but parking in drive way opp to other parking slots.Reported to Builder,management&maintenance incharge but no action.The new buyer parking his car in driveway.What to do?Builder not taking action though pocketing maintenance charges.Advise please

I am staying in New Mumbai, we r facing Big Problem, Builder is not supporting us (to all flat owner) for form a society & transfer Land.
Plz advise wht to do ? ??

I PURCHASED A FLAT IN VIRAR FROM MAYFAIR BUILDERS THEY GIVE A BIG AD SAYING THEY ARE FIRST TO SELL FLATS AT CARPET RATES BUT IN REALITY THEIR PRICES ARE MORE THAN THE BUILTUP COST COMPARED TO THE OTHER BUILDERS AND TO MAKE MATTERS WORSE THEY ARE ALSO SELLING OPEN CAR SPACE TO FLAT OWNERS AND EVEN GETTING IT REGISTERED THIS IS HOW OUR CORRUPT STATE GOVT. WORKS OFFICALLY THEY ARE HELPING THE GULLIABLE BUILDER.
ONE CAN'T UNDERSTAND HOW CIDCO IS APPROVING G 7 FLOORS INSTEAD OF STILT 7 FLOORS. WHERE WILL THE PEOPLE WALK FREELY.

Carpet area mendatory

legally compulsory to be made that all deals should happen on carpet area as it is all that matters for all uses, let cost appreciate at least one lay man can measure that other banefits can be taken as value adds. no other charges other than day to day maintenace should be incurred from the customer, this way govt. can help the people.
