Hi Prakash,

I am a student in the US and probably am not one to provide reasons, but the general rule is that the visa officer must be convinced of the veracity and sincerity of the applicants. A visa is not a right, it is a privilege. Well, they could try again after some time and after consulting with some experts.

Settling in the USA!
by Sharmila S on Oct 13, 2005 06:09 PM  | Hide replies

Hi,

Will it be easier to settle in the US by studying there or going directly to work there? I have done a diploma from USA by correspondence (recognized by DETC) and have also worked for a US-based company in India. Will it make it easier for me to migrate there?

Regards,

Shamz

H1 visas are issued only to graduates, diploma holders do not qualify. Distance education programs are not usually recognized.

Settling (PR/Green card) is independent of how you get there. Past employers have no influence on visa or residency. You could try a student visa or non-professional H2 visa but you need to find a US employer willing to employ and sponsor you.

H1B Visa question
by Arjun on Oct 13, 2005 02:16 PM  | Hide replies

Hi,

Currently I live in India and I have a valid stamped H1B VISA through my current employer.
I have got an offer from an US Employer who is asking me to travel on the current VISA. The US employer says he will tranfer my VISA once I land in US.Is it legal to travel with my current VISA for another employer? Please Advise.
