While repeated terrorist acts were going on, our PM was telling current laws are good! Centre did not approve tough anti-terror laws of Gujarat, Rajasthan and some more. If traitors rule see the result for yourself! Indian judicial system, especially CJ, is partly responsible for the repeated terrorist acts! Conviction in criminal and rape and murder cases: 6 percent. Conviction rates in terrorism cases is hardly 2 percent. The trials can go on for ever. Meanwhile many get bails or freed on most unusual/technical grounds! Let us take the case of 1993 Mumbai blasts. The most glaring example of laws bowing before rich and famous is that of Sanjay Dutt. In 2007, Sanjay Dutt, Memon relations and some were convicted in the lowest court. With more than 45000 cases, how SC CJ’s bench found time to hear and give bails to Sanjay Dutt and Memon relations? Bails were sent by e-mails!!! Was this the most important case? Are there no courts in between? In Sanjay Dutt and Memon relations case, ASG supported the bails! Terrorism convictions in the US, UK and many other nations are as high as 90 percent! 9/11 and London train blasts were the last ones in US and UK. Many European nations also preempt most of the terrorist attacks. How many are being prosecuted in terrorism cases including disgraceful 2006 Mumbai train blasts? 26/11 is an international disgrace and we have become a laughing stock all over the world!
Many talk big like “constitution”, “impeachment” (no impeachment done till now), “contempt”, “equal treatment of law”, “due process” , “jail” and so on! There are some basic principles of democracy. From these a constitution is derived. In Indian context, our constitution makers borrowed mostly British system with some tinkering to account for our conditions! Since then there have been huge number of constitutional amendments, not heard of in any democracy. So we have retained shamelessly the British dress codes (suited to cold countries), the vacation systems (suited to rulers) and conventions!!! Contribution of our judicial system has been gross misuse/abuse/rape of all laws enshrined in the constitution! UP PF scam where judges took bed sheets, bed covers from the Class IV employees PF speaks volume of the stinking corruption/abuse! In the UP PF scam, one SC justice, 11 HC judges and about 20 lower court judges are involved! Now our CJI, who has billed even his private foreign tours on govt money (our taxes) is talking of impeachment (no impeachment made in parliament till now), zero tolerance for corruption and so on despite best efforts to stall the investigations in this scam. On RTI, our CJI mentioned that he is not a public servant! Then who is footing his bills? Current CJI is responsible for protecting the corrupt and criminals in the judicial system. Most will deny! But it is proved beyond doubt from most of the actions, that it is so!
In most of the democratic nations, one is innocent unless proved guilty “beyond reasonable doubt”. In India, this “beyond reasonable doubt” is twisted to mean “beyond any doubt.” If one is not able to do/study anything (with a few exceptions), then one takes up law. Here those who don’t have much practice become judges and justices. In many states, there are rates for becoming judges too! The same is reflected in all courts across nation. There are bail rates in most of the courts! So even after murders, worst terrorist actions, one can see culprits getting bails between long trials. Some of these trails are creating world records! In courts, good lawyers twist the words and cases so badly to “beyond any doubt” that over awed justices free a good amount of them, there are notional sentencing and then bails between next appeals. Here SC CJI is the worst offender by giving bails to Sanjay Dutt, Memon relations, Monica Bedi and more. Conviction rate in terrorism cases is two percent! If terrorism, murders and rape and murders are low risk business, are not the judiciary and laws guilty beyond all doubts?
The Congress is enacting this ridiculous Circus of a Civil Court Trial for Kasab, and wasting the taxpayers' resources and time on this meaningless farce. The whole world has witnessed on television, as Kasab committed his crimes. What is the Congress trying to prove by having such a civil-court-trial ? Whom is the Congress trying to impress ? An Arab newspapers has praised Kasab's trial, so it looks like the COnress is trying to impress the Arabs.
This matter sould be handled by a Military Court, because Kasab is charged with waging war against our nation. Kasab is not an Indian, so he is not entitled to a trial by an Indian Civil Court.
Kasab should be in the custody of the Military. The Military Court should efficiently prosecute the case against him. If found guilty, Kasab should face a Military execution.
See how the USA is handling its 9/11 accused. They have created a special system and a special location (on the US Naval Base in Guantanamo Bay, Cuba) to handle these cases. There is no needless circus of a Civil Court Trial for these accused.
The nation went through trauma during 26/11. The Congress is now making the nation re-live this trauma.
