judiciary and legislature
by P. S. Subramanian on Mar 20, 2005 08:50 PM

the indian constitution clearly defines the roles of the judiciary and the legislature. Undue interference by the judiciary in the legislative process is against the basic spirit in which the constitution has separated these two functions. The Supreme Court's order adavanceing the jharkhand trust vote is a case of interference, which is not desirable in a democtratic nation, in which the legislature is the representative of the will of the people, and these matters are best left to the executive and the legislature.

SC has no job to interfere..
by Uma Shankar Ladha on Mar 11, 2005 10:31 AM

SC should better check its own house. With magistrates issuing warrants against president kalam, they have no right to interfere with the due process of democracy. Just as the public is warned that they cannot comment on the process of justice, similarly judiciary cannot interfere with the due process of democracy. They are not the elected one. They are umpires and better remain in their places.

(One note to the editors of rediff.com - I have been posting for the last two months and none of my messages have ever appeared on the messages board. This again shows censorship. I havent used vulgar or obscene words. Used the language of protest which the politicians are using and you are too happy to publish on your website. )

SC orders Jharkhand legislature to prove majority on 11th March & no new nomination
by Prof Rajendra Aggarwala Lt.Col.(retd) on Mar 10, 2005 03:49 AM  | Hide replies

SC,s order brings utter shame to the Jharkhand's legislature, even more to the Governor, whose unconstitutional manipulations invited SC's unprecedented intervention. It has lowered the dignity of all the legislatures including the national parliament. Primacy of the legislatures has been whittled down for ever.
It exposes the Sonia's Congress-cum-UPA's leadership including the Government of ManMohan Singh to charges of criminal conspiracy. Even the English media is a party leading to the crimes. But for the media's blind support to the fascist activities of Sonia Gandhi, she and her henchmen could not have dared do what they thought they could get away with impunity. UPA has been shamelessly claiming that coalition politics compels it to have criminals as ministers, chief ministers/Governors. The media let UPA get away, thanks to its 'indulgence' with the 'white skinned foreigner' at the helm! Media backtracked only (on Jharkhand fascim), when it knew that BJP had 'managed to save its legislators' to present before the President and the matter had come before the SC.
The question is- "Is India being ruled by a coterie of criminals aided by the English media?"

After order of Hon'ble SC on Jharkhand, it proves once again that politics has become business and our politician businessman of politics and playing with coutry's future for their vested interest. No concern for the welfare of countrymen. Instead of imposing president rule in any state, should be think rule under CJ of high court of the particular state for impartial governence.
