ANTI DEFECTION LAW

The author has rightly suggested a revisit tot this law.Way back in 1980s when Haryana and to some extend all northern states were facing defections amongst legislature,it was need of the hour. At that time I had suggested that the defecting (not the one who was voting against the whip) be barred from taking any post of profit for at least a year.This would prevent malpractices by political parties. Further political parties and their legislative wings seldom discuss a new bill,which their government proposes to bring in. If this is done a then a good number of legislatures will be able to voice their views fortifying the freedom of speech.But leadership of all political parties are afraid of it,because they are family owned and legislatures are 'bonded labours'.

There should not be any PRE OR POST Alliance because it is very much clear that 2 or more parties have different ideology for development of any region or society.
so , if they are really honest for public rather than VOTE BANK , then they will do all best work for ABSOLUTE MAJORITY.
In cases like present situation , single largest should rule for one year & then everyone should go for election to get ABSOLUTE MAJORITY.
This is because we have seen lot of drama in previous few years & lot of wastage of time , money and even life of many ON or OFF DUTY PERSON.
This simple formula can give us good working politicians and political parties.

not so simple in a multi-party system - no one will strive to get absolute majority - will just try to get one vote more than the others and become the single largest party

Can an elected representative vote for or against a motion without having to defect his or her own party ?

Anti defection law prohibits party hopping. It does not prevent elected representatives from casting their votes in crunch instances.

For example, should JD(Scum) MLAs feel that BJP rightfully should form a government, can do so by declaring support from outside without having to defect a party from which they are elected to the Assembly.

The legislator has to think not only about his own party, but also the people who have voted him/her to power. If one goes with one party to the voter and gets a mandate, then pre & post alliances changing as per parties whims and not considering the individual legislator conscience or the people's mandate is a crime. There must be means in party democracy to deal with legitimate dissent, difference of opinion. Black money, horse trading, corruption is a different subject altogether. Ideally our financial rules, regulations, laws must be strongly in place to ensure that there is no possibility of exchanging money 'especially exhorbitant cash', unless it is legally accounted, tax paid and transacted by diligent accounting practices. Demonetisation was supposed to have achieved that, but didn't. Whatever black existed before, looks like exchanged from old notes to new notes, but remained black that is why politicians are talking about 100's of crores and also paying the electorate. If cash limits like 20,000 for individuals, 2,00,000 for business existed and exists, then how come such big money can be transacted for luring legislators.

Especially allowing few losing parties to come together to cobble up so-called coalition and working against the country on coalition compulsion like Manmohan did, must be looked into carefully to ward off looting of the nation...
