Collegium meet today to reconsider name of Justice Joseph

The current CJI - a dispassionate opinion

4 senior most SC justices challenged and questioned him publicly. The impeachment reasons are definitely serious though they can be verified. Matters after matters seem to be decided by the CJI, with same two other brother justices, which has formed a pattern already. CJI has already expressed favourable inclinations towards what the govt. wants, includng rejection of Justice Joseph and approval of new Justice Indu Malhotra, directly nominated. This country will therefore be content if Justice Joseph is inducted as SC judge, defeating pressures and limitations being brought on the Judiciary

Justice Joseph is a biased judge, else common man does not have faith in judicial system, it only covers either the cases of high profile politicians, businessmen or spoiled by media.
Common man knows that under the nose of a judge, daily Peshkar or Reader takes bribe, no action is taken to curb it.

He will be remembered for domesticating CJI post to there political master.

His inability to work within constitution boundary and with professionalism is because of his malicious mindset to befit his master.

Raja, do you know the power given by the constitution to CJI for allotment of cases ? Do all four judges who staged revolt against CJI were not aware about his absolute power to allocate work ? do that joker Prashant bhushan didnt know this as senior advocate of Supreme court and mentioned his case before Justice chelameshwar when the three members bench had already decided the issue ?

Anything tending to expose arrogant and not-so-straight decisions and deliberate frictions generated by the govt. need not be the wishes of the Congress. This time, it is the entire nation who is speaking openly. That needs to be taken note of.

Supreme court collegium want an absolute authority to consider an appointment of judges of High court and Supreme court. The chances of misuse of power of Such absolute authority vested to only one institution is not correct. Judiciary always have confrontation with executives and always want to show their superiority. It is not good to totally ignore the the involvement of government elected by the people in the process of selection.

Govt.elected by people, in majority,gives it power and facility to make any decisions, pass any law. That just cannot be the final diktat unless and until it satisfies the requirements of the Constitution. The Supreme Court alone is the arbiter to decide that and make sure that the govt. does not convert the nation into a banana republic or a dictatorship charged with any unConstitutional intents.

If the government can accept a ruling by the supreme court and even overturn a bill passed in parliament, why can't the SC appoint a judge?

Government formed by a democratic process, But collegium is nothing but a khap panchayat. Some senior judges sit together and decide who will be judge. What is a logic behind an Act passed by parliament to be overturned by SC. One of the member of collegium itself had came in public that the collegium system is not transparent. If that is so what will be transparency in the judgement delivered by such selection.

It is an insult to compare a Khap Panchayat to the Supreme Court. SC must overturn every act which is not according to the Constitution. The selection and inclusion of Justice Joseph is a certainty.
