The judiciary has two key functions -- to decide individual cases and maintain a check on the government and legislature," says Prashant Bhushan, the lawyer and activist spearheading this campaign. Please tell on the success rate in these.Tell on the extent of backlogs? Why? Give no reasons for not solving ,70 yrs is too long .ALL ARE COMPLICIT; BE HONEST TO ACCEPT.With all your check on Govt. we are a country of heavy corruption, our Parliament doesn't account for money spent spent on Local Area development Fund . Why at all LADFMP should be there. Why at all money must be spent in the name of spoken language of pakistan to write it in Devnagri Script to call it Hindi,Is it for siphoning money or for anything else.Judiciary has failed in both the functions R.PONNAMBALAM

It's time for the internal workings of the courts, such as judge appointments, to be made equally so.Make all internal work as roadside external work .."Give it to political parties so that corruption cases of Politicians can be decided in their favour. Make a collegium of political parties and divide the pelfR.PONNAMBALAM

by R ponnabalam on Mar 30, 2018 06:56 AM

"These steps will go a long way in improving the Indian judicial system".When and how did you allow it to deteriorate>?What improvement is wanted?Justice always has to be transparent, has to be ever transparent else it injustice.Justice has to be seen to be done !When justice stopped being transparent. What are the causes ? Who had caused it.Committed Judges.Committed to what?"its progressive judgements".What progress we have achieved. We cannot punish Corrupt politicians, we cannot recover bank loans,we cannot have a corruption free Indian Administstion in Govt, offices, we cannot have societal equity. We want to perpetuate wrong doings in the name of REFORMS as we had built loss to the banks by way of Economic Reforms R.PONNAMBALAM

Judgement Fixing is the game
by R ponnabalam on Mar 30, 2018 06:44 AM

Additionally, our systems tend to have an elitist bias," says Bhushan. "This makes it hard for slum dwellers, refugees, street vendors and others to get justice."When was it not for the past 70 yrs? It is always so.Let us REMEMBER MRS.I.GANDHI "NEED BASED WAGES CANNOT BE GIVEN"said during railway strike days. What we have done for slum dwellers, street Vendors.Who had taken their cases to Supreme Court. We take the case of people who as a specific language speaking people of a specific Religion had claimed themselves as separate Nation from INDIAN NATION and for whom that Nation is available now as Bangladesh and who are ever a National Security concern. We didn't give refugee to the Bhutanese in the past. There is dirty politics lurking in all these.Bench fixing Judgement Fixing is the game of Judicial Reform R.Ponnambalam

" transparent and accountable judiciary "Please tell us from when onward our judiciary is not transparent and accountable? What we all and the Fraternity of Law have been doing against that loss of transparency and accountability?Who had earlier taken such cases to the President? What is this so called REFORM.We have had Economic REFORM without those doing and making Reform planning and making ways for recovery of Loan. Now we have Judicial Refom! What? JUSTICE has to be reformed so as to be administered in Press conference.Litigants can decide the bench.Indian Judiciary has lost the respect and the faith of the people as did the banking Sector. All these sectors are political sectors in different robes R.Ponnambalam

JUDICIAL REFORM
by on Mar 29, 2018 05:36 PM

THIS ARTICLE DOES NOT BRING OUT JUDICIAL FORMS. WHAT THIS TALKS ABOUT IS ONLY PROCEDURAL MANIPULATION. THE REAL REFORM IS TO SEE WHY SO MANY CASES ARE PENDING FOR SO MANY YEARS. WHILE WE TALK OF 'UNEMPLOYMENT' , SPEEDIER JUSTICE COULD NOT BE PROVIDED DUE TO LACK OF JUDGES AND JUDICIAL AUTHORITIES. WHY NOT WE HAVE FOUR SUPREME COURTS IN DIFFERENT LOCATION LENGTH AND BREADTH OF THE COUNTRY. WHY NOT WE HAVE FOUR OR FIVE HIGH COURTS IN EACH STATE. THE CATEGORY CASES SHOULD ALSO HAVE TIMELINE FIXED WITHOUT GIVING UNNECESSARY DATES. COURTS SHOULD FUNCTION THROUGHOUT THE YEAR. WHY SHOULD THEY GO FOR SO MANY LEAVES IN A YEAR. PATHETIC COURTS, DELAYED JUSTICE, UNWANTED PROCEDURES, LACK OF COMMON SENSE, LACK OF SENSITIVITY, WASTAGE OF TIME... ALL THIS TO BE PLUGGED AND COMPLETE TRANSFORMATION IS REQUIRED FOR JUDICIAL SYSTEMS ... INSTEAD CONFUSING THE ISSUE OVER TRIVIAL MATTERS...

How come it is not political issue ?
by auryas on Mar 29, 2018 03:56 PM

The impeachment motion against the CJI is just that. The opposition actually stopped short of calling Deepak Mishra ( the CJI ) biased.

The opposition in this country has become like a desperate, sick minded power mongers who lost sense of propriety or where to draw line.

Look at them - Mamata Bennerji, Sharad Pawar, Sonia Gandhi, Mayawati, Akhilesh Yadav. They are like a bunch of predators waiting to prey. They do not care if the country goes to dogs. Each one these people is more desperate than others.

Shanthi Bhushan's proposal
by auryas on Mar 29, 2018 03:53 PM  | Hide replies

Shanti Bhushan's proposal is like giving a sack of stones to a bunch of stone pelters.

This weird form of democracy is becoming weirder because of wrong ideas propagated into the society with make believe similes.

Elitist bias ? So what does Shanthi Bhushan imply by this ? Each time a case is won by some one with more money , the judiciary is automatically swung to the side of elitist ?

Nowhere in the world oppression is manufactured , romanticized and propagated like in India.

Why not leave judicial reform to judiciary.

The reason why Indian society sucks is because we do not have patience as the system evolves. Instead we inject steroids for FASTER changes - like having a baby in 15 days instead of 9 months.
