4 judges
by arungopal agarwal on Jan 15, 2018 11:02 AM

They could not wait even for 2 months, whereas people wait even for 20 years for a judgement. Great.
All are disturbed due to Loya case-due to congress behind curtain, OK, let everyone whosoever he is in govt. service must be retired early if he is suffering from chronic disease such as diabetes, hyper tension or similar type so as to avoid any doubt over likely death- whether killed or natural death. This lesson must be learnt by govt.

Supreme Court (File | PTI)
NEW DELHI: The unprecedented tussle between top judges of the Supreme Court continued on Saturday with Chief Justice of India (CJI) Dipak Misra overruling an order passed by Justice J Chelameshwar on Thursday to constitute a five-judge Constitution Bench to examine if a Special Investigation Team (SIT) probe should be ordered to investigate alleged corruption in the higher judiciary.

The Chief Justice replaced the five-judge Bench with a new Bench comprising three judges. He also issued a circular late on Friday making it clear that henceforth, all lawyers must seek hearing of all new cases before the Chief Justice.

“It is hereby notified for the information of the Members of the Bar and the Parties appearing in person that henceforth oral mentioning, in respect of matters which have not already been assigned/listed before any other Bench, will be allowed only before the court presided over by Hon’ble the Chief Justice of India at 10.30 am,” the circular reads.

The circular implies that matters would have to be mentioned before the CJI’s Bench even when he is sitting at a Constitution Bench hearing.

Should a Judge With a Serious Moral Flaw Become Chief Justice of India?

Given the allegations of impropriety against him, should Justice Dipak Misra become the next CJI just because he is the senior-most judge in the Supreme Court?

The CJI wields enormous power in shaping the future of the judiciary. Credit: Twitter/Reuters

On August 27, Chief Justice of India (CJI) J.S. Khehar will demit office. The next in line is Justice Dipak Misra, but should the vacancy be filled up simply by the rule of seniority?

The CJI is a constitutional authority and presides over the country’s judiciary, comprising 31 Supreme Court justices, over 1000 high court judges and over 16,000 subordinate judges. The CJI dispenses justice in the highest court in cases involving complex constitutional issues, issues affecting the rule of law, issues having an impact on governance in the country, issues touching the lives and liberties of 1.3 billion Indians, and dispenses justice in regular civil and criminal appeals. As head of the Supreme Court, the CJI wields wide powers not just in administration but also in constituting benches and allocating matters, often politically sensitive ones.
In the First Judges case, the Supreme Court emphasised:

“Judges should be of stern stuff and tough fibre, unbending before power, economic or political, and they must uphold the core principle of the rule of law…”

Veda Vaidya, don't just copy paste of comments written by others. Your brain has absolutely no capacity to understand anything. Can you define and specify serious moral flow of Chief Justice of India ? Do you have any knowledge how CJI and other Judges of Apex court are appointed ? Just borrowing comment from other sources will not help if you yourself don't understand what you have written. Your capacity is only to work as an extra dumb artist and nothing else. Don't try anything else.

NEW DELHI, NOV 10:
A five-judge Constitution Bench of the Supreme Court today overturned an order of a two-judge bench to set up a larger bench to hear a matter of alleged bribes taken in the name of judges, saying the Chief Justice of India was the “master of the court” and had the sole prerogative to allocate matters.

A five-judge Constitution Bench headed by Chief Justice Dipak Misra, which assembled urgently at 3 PM, said neither a two-judge, nor a three-judge bench can direct the CJI to constitute a specific bench.

The bench, also comprising Justices R K Agrawal, Arun Mishra, Amitava Roy and A M Khanwilkar, annuled yesterday’s order of the bench of Justices J Chelameswar and S Abdul Nazeer directing the constitution of a bench of five senior-most judges of the apex court to hear the matter.

“Master of the court”

The larger bench today took strong exception to the order passed by the two-judge bench and said that no bench can take up a matter unless allocated by the CJI who “is the master of the court.”

The CJI-headed bench said that the allocation of matters by the CJI was the principle of law, judicial discipline and the decorum of the court. The CJI also refused to gag the media from reporting the case, saying “I believe in Freedom of Speech, Expression and the Press.”

The CJI told advocate Prashant Bhushan, who appeared for NGO ‘Campaign for Judicial Accountability’ and advocate Kamini Jaiswal,

Komaaaaali party (BJP) men
by piri on Jan 13, 2018 11:15 PM  | Hide replies

were getting more and more excited !

And komaaaaali Modi and gas Shah were working themselves into a frenzy of excitement !

The PILs challenging the faulty and poorly designed Aadhar linking with personal accounts were assigned by the CJI to an amenable judge of the govts choice, in violation of the Memorandum of Procedure for deciding the bench and bench strength for trying such cases !

The Justice Loya murder case was assigned by the CJI to a similarly amenable junior judge in violation of the Memorandum of Procedure for deciding the bench and bench strength for cases of such import !

For the komaaaali govt, several other equally frightful cases were coming up !

The CJI, going by what he has been doing for the past 2 years, could certainly have been trusted to similarly *handle* each of these cases !

But now........ all that excitement has been rudely interrupted by these 4 dirty judges !!

They have driven that tiny element of doubt into the komaaaaalis mind !!

Will the stuxpid north Indian voters, who could be normally trusted for being stuxpid enough to buy the lies, exaggerations and diversionary ploys of the komaaaali and fall for his shrill grating voice..........begin to sense that there is something seriously amiss ??
