Suddenly Rajiv Malhotra's book breaking India which draws on the strategy of a anglodalit rebellion with support of leftist naxalites makes more sense. I think these 4 should be pulled up with serious investigation by ED and Intelligence Bureau.

The Narendra Modi govt,
by piri on Jan 13, 2018 07:56 AM  | Hide replies

with Mr Ravi Shankar Prasad as a front, had consistently been attempting to package its proposed NJAC as a step towards bringing in transparency in the running of the judiciary.

Wanting for long to get its hands in on the choice and appointment of judges to the higher courts, the Modi govt began criticizing the Collegium system that has been prevailing for a quarter of a century with the allegation that its decisions are not transparent.

The Collegium system came into existence after long wrangling in legal and govt circles as a step towards making the judiciary truly independent of the executive as envisaged in the Constitution. Mrs Indira Gandhi had blatantly intruded into the independence of the judiciary by selecting the Chief Justice of India based on personal preferences rather than on the seniority criterion that had been prevailing till then.

In its October 3, 2017 resolution, the Collegium of judges (Misra, Gogoi, Chelameshwar, Lokur and Joseph - precisely the 5 judges who are at the centre of the controversy today) decided to hitherto publish all its decisions regarding the appointments, promotions and transfer of high court and Supreme court judges on the official website of the apex court.

The judges also resolved that the reasons that made them choose the names for appointments and transfers would also be posted on the website for public access. The Collegium followed this resolution by publishing the appointments to the Madras and Kerala high courts

That does not explain why one of the seniormost judges has to meet a CPI leader immediately after the presser. They have left everything subjective without substantiating as to what was the procedural or immoral wrong doing committed by the present CJI.
By coming out in the public they have shown they are no different than VK Singh, who committed the same blunder of washing dirty linen in public. VK Singh was COA, but these judges are supposed to have much more wisdom than a COA.

Also coming out with a presser only shames the institution that you are part of. If you are not happy with what is happening in the insitute either you talk to your boss or you step down from there & then go public. These 4 have clearly shown that all the emoluments that come as a SC judge are very dear & cannot be given up, so they choose to badmouth the SC itself with innuendos.

Everywhere the rule is straight & simple, either fall in line with your boss or choose a different work place. If the boss is doing something anti social or illegal then there are enough checks & balances to take care of him/her as well. Being in SC, rather than coming out & wailing like a child whose toy has been snatched they should have internally resovled this matter.

And that is to publicly call the bluff of a boss who is a big time thief !

with a note giving its reasons for each appointment.

This measure has apparently taken the wind completely out of the sails of the Modi government and it is left flailing about without any locus standi in its pretenses about ushering in transparency in the running of the judiciary !

That something has been seriously going wrong in the top court in recent times has well been evident from the manner in which it has vacillated in several of its recent pronouncements (Aadhar linkages, Justice Loya murder, etc.).

This is blasphemous. These 4 judges have crossed all the limits of decency. I feek they should be dismissed and enquiry should be instituted against them. Also IT and ED seraches should be carried out plus who are the people behind these - I suspect Congress and Leftists behind this. By the way what was the need for Chalmeshwar to meet Leftist D.Raja yesterday? Can the public know aht transpired? It should be made public. Also Chalmeshwar was whispering something to this friends and some media men have heard. What was his saying. Everything should come out to expose these blot in the face of judicary. One thing is certiab. These Gang of $ should be sacked immediately.

my dear friend with 24 hours our judiciary system highlighted publically and now entire world knows the working of judiciary system. such type system is working other country also but it is in confidentially but in our country it is open the working of our govt, judiciary , military and many other important society. it is really insulted to Indian as well as Indian people. what international community will think about us above all what is the impression of our PM who is meeting every now and then to international leader, how our business with internationally improved. looking all these senario it is advisable to stop to critize one another instead of digging more on this subject. if you appoint CBI/ED for this it is further havoc much insult to the nation and our nearest enemy will laugh on us.so reader and commentator please stop this subject here itself and forget the matter and allow the govt to work and particularly BJP/congress people to stop to pin point one other for the sake of saving further insulting from international community. whole world know India is a biggest democratic country but inside the democratic is big zero.

Mr Kamath, do you think that such press conference can be arranged at a very short notice ? There is every possibility that one of the political party which is expert in arranging such events may have played an important role behind this revolt. The leaders of such parties are always first to attend any agitation against the government by any one.

Press conference of four judges of Apex Court
by P S SHAH on Jan 12, 2018 10:45 PM  | Hide replies

Justice Chelameshwar, Justice Ranjan Gogol, Justice Madan Lokur and Justice Kurien Joseph are Judges of Supreme Court for more than five years. Did they find everything proper allthese years and suddenly found everything wrong in the working of Supreme Court ? They are talking about danger to democracy but has any one of them has ever seriously thought about the plight of poor and uneducated undertrials who are serving sentence for more time than the offence they have committed if any?have they ever thought of reducing their long vacations, increase number of working days and toclear the backlog of pending cases ? There is no different in the Politicians and them which they have shown by their press conference. They have played a simple politics by calling press conference and distributing their letter to CJI which do not give any specific incidence where CJI and Apex court has gone wrong. This four senior judges has miserably failed to peruse CJI that certain things in Apex court are not in order. They are only convinced that democracy is at risk without giving reasons for their stand. They have only decided to play to the gallery to show them as hero and only protectors of democracy by telling the nation that "they owe a responsibility to institution and nation " as if other than them no have such responsibility to the nstitution and a nation. The Chief Justice of India should not attend any representation from them till they apologise for their misconduct.

Completely agree. Without substantiating anything against the CJI, they have gone public. They have made the worst blunder of their judicial careers even worse than what the then COA, VK Singh had done by washing dirty linen in pulic.

I wonder what purpose has been achieved by this press con. Is it going to solve any of the problems they have highlighted or is it going to bring any radical change in the system which has been well laid down by the constitution of India?

You are absolutely right.
Is it a plot to dis-stabilise the system?
The administrative machinery is has turned too rigid for so-many years. Judiciary is also no exception.
The CHANGE can not inculcated so easily.
