Judges upset with Centre for lowering Justice Joseph's seniority

It's clear that the govt. has malafide intention insofar as Justice Joseph is concerned.

It's unfortunate that the CJI is not doing anything about it.

The CJI has shown himself consistently favouring or assisting the govt. wishes in several matters. The govt. also is doing its part by thinking of raising the retirement age of SC judges, thereby assuring the CJI an automatic extension even at the cost of extension to all judges. Some important judgments are due in coming times, and the CJI may then be important. It is almost certain that the CJI will not raise one little finger against the injustice being meted out to Justice Joseph in terms of seniority etc.

The collegium headed by Justice Deepak mishra approved appointment of Justice Joseph to Apex court and the collegium forwarde their recommendation to the government as per the rule. Before appointment of any judges, the government has to get confidential report about the person from various agencies and getting clearance from this agencies, finally the government clear his appointment. Justice mishra had performed his duties as a head of collegium and one can not blame him for any delay in appoinment of Justice Joseph as the Judge of Apex court.

I Banarjee became HC judge on Feb 5 2002
Vineet saran became HC judge on Feb 14 2002
Josepth became HC on Oct 14th 2014.
You decide who is senior.

Justice Chelemeshwar became a judge before Justice Deepak Misra. But Justice Deepak Misra was appointed to SC 4 months before Justice Chelemeshwar and hence Justice Misra superceded Justice Chelemeshwar and became the CJI.

In short, when one becomes a judge is not important, when one becomes a judge of SC is important.

Fact is,the seniority is decided by the date of joining as a HC judge as per today's TOI. That's all. So this Joseph fellow is 3rd and juniormost. As simple as that. The idiots who are "upset" are part of a dangerously corrupt and anti-national CABAL - a cabal including judges and lawyers, besides the media like your site and Lutyen's darbaris in general, who are slaves of the Nehru-Italian-dynasty. Such thinking and disrespectful words can come only from people who are blinded beyond hope. Those counterfeits calling themselves nationalists did things against this nation, starting with killing of the Mahatma, and killing thousands in Gujarat etc. The SC judges who lodged protest before the CJI surely do not belong to any gaumutr culture. The cabals of judges and lawyers today already are ministers. If Nehru-Gandhi had not served India, these cabals would not have seen the daylight. The fact is this vicious and rabid and fanatic communalism and hatred is destined to end soon and the nation is looking forward to the 2019 elections.

Judges are forgetting this is a democracy

It looks like the judges and their hand maidens, the advocates, are forgetting that this is a democracy where the ultimate power is wieleded by the people and the power for law making has been delegated to their elected representatives. Judiciary has only been given the power to interpret laws in situations where there is ambiguity in the laid down law and also to fill in gaps where they exist in the laws made. After holding even right to life non sustainable during emergency and inventing non existing meaning for the term consulation used in Art 124(2) of the Constitution with respect to appoinment of judges and dumping a law for appointment of judges duly enacted by those empowered to do so it appears that the judges want an executive just to sign on the line dotted by them! It further convinces me that this country cannot become truly democratic unless the judiciary is totally overhauled which may be possible only with a Constitution that is rewritten keeping the aspirations of a nation raring to go and earn its place of pride in the comity of developed nations where the rule of law is a reality!
