Justice Gogoi - the next CJI

I am confused on the 4 judges who conducted the presser. In that, they said - though CJI is the master of the roster, he is just first among equals. In the same breath, they said, Senior Judges are not given 'high profile/ sensitive' cases. When they say all judges are equal, then where is the question of senior judge and junior judge. Anyone who is elevated to SC is supposed to be competent enough to handle any case. Just becoz, they served more time in SC does not make them automatically eligible to hear sensitive cases. In my opinion, CJI is legally and constituitionally authorised as 'Master of Roster' to allocate cases based on his judgement at that point. These judges have axe to grind against the current CJI (becoz of their ideological views) and hence, they have destroyed the reputation of the SC itself by holding the presser. IF current CJI is allegedly prejudiced, then these judges including the future CJI will be definitely prejudiced in allocating the cases. Anyway, what goes around, comes around. We will also going to see the bench allocation of the future CJI. These judges have brought limelight to the normal activity in any court, let alone SC and now every citizen including media will be looking at the allocation of judges to the benches by all other future CJIs esp Judge Gogoi.

Who is next CJ depends on reasoned decision.

The present CJ might have personal reasons to deny senior judges appropriate cases dealt by constitution benches, but his recommendation about his successor has to be maintaining tradition followed by his immediate predecessors. Any deviation would substantiate allegations of four senior judges.

Justice Gogoi's elevation
by Mukund Barve on Sep 04, 2018 02:40 PM  | Hide replies

That Judge, who does not himself observe judicial ethics, how is he expected impartial justice? Addl. Commissioner of Police was admonished to go before press when the matter was sub-judice. Were Qurtet of Supreme Court judges, supported by CPI,super human beings or above law? Were they more equal? Same class needs to surpass and precede firefighters, ambulances on the nationalHighways
