Judicial reforms
by arungopal agarwal on Feb 02, 2016 04:59 PM

Big praise for Modiji to drastically amending Arbitration Act and implementing commercial courts, we expect such reform urgently in consumer protection act and other similar tribunals etc., so as to get quick decisions.
Actually country needs urgently a correction that a criminal suit must be settled in one year time and civil in 3 years time so as to win the confidence of masses.

Hearing

The problem with Judiciary is the "Hearing". If there is a filter in the admission stage itself many litigation would disappear. for this the registrar who numbers the case should be a judge or retired judge who would know the nature of litigation.

Many civil cases can be resolved by E-Courts such as for cheque bouncing, co-op society matters, tenancy, Tax disputes, etc. which are based on documents and no personal hearings are necessary. Open E-Courts for such cases. No hearings, no adjourments.

There are tribunals for these disputes.

I know but tribunals take 1-2 years to get a hearing and there are various adjourments because of backlog.

Delay
by Lav Vaidya on Feb 02, 2016 11:55 AM

It necessary to understand that about 65000 cases are filed every year in Supreme Court. There are less than 30 Judges. But if litigants are vigilant, it doesn't take too long to complete judicial process.

I started a consumer case at lowest court. Appeared my self.....no lawyers. Case went to higher courts and finally ended up at Supreme Court. Got a favorable verdict. All within 8 years.

I support Nyay Yatra and would like to join it.

Great BUT ...
by Vijay Sahani on Feb 02, 2016 11:25 AM

No government is interested in reforming Judiciary or bureaucracy. An efficient judiciary or bureaucracy will act as a bulwark against the selfish motives of politicians. Hence, all politicians will unite to scuttle all such efforts, as they did with Jan Lokpal.

Justice delayed is justice denied. It is a general feeling the cases linger on for no reason for years together. If our judicial system sincerely work, delay could be avoided in at least 90 percent cases. It is the general opinion of the people that decision is delayed intentionally to favor some for reasons only known to them.

Judicial Process
by chilluchillu on Feb 02, 2016 10:14 AM

While the supreme court acts like a big brother giving morality lectures to everyone it should look inside as well. The judicial system is as corrupt like all other fields like politics , police etc...Why cant they make the legal process better and faster ?? Use technology as most of the cases are repetitive in nature and can be judged on previous references..may be this will put lawyers out of work...thats why.

Justice
by arungopal agarwal on Feb 02, 2016 09:50 AM

We may be boasting about our judicial system, may be most decent too, but common man does not have faith in it in India due to its very very high time taken rate. Also we find in a temple of justice, under the nose of judges-reader and Peshkar takes bribe.
Maximum leaves are taken by judges, they consider themselves different to common man and are away from ground reality of life. As such only look at legal truth not actual truth.
