Underpaid Indians
by Aditya Bose on Feb 18, 2014 12:57 PM

Devyani was charged for underpaying her maid. Just see at any tea shop or roadside dhaba at anywhere in India, you'll find little kids who work there. Are they even paid ?

For at least once, India should look itself in the mirror, rather than accusing others.

The Americans have mocked India's judicial system, what if?
by nanu on Jan 19, 2014 06:18 PM

In spite of orchestrating various scams Sonia Gandhi, Dr.Manmohan Singh, Chidambaram and entire cabinet of UPA Govt. roaming scot free. There is no system or machinery to punish them. Any sane and prudent Indian will not have any faith in the system in India. This UPA Government has established INDIA as a banana republic to the rest of the world. How come we expect the Americans not to mock the India's judicial system, if this is the fact here?

Sorry Mr Sibal, you are not doing justice by supporting Devayani
by Narayanan Subramanian on Jan 19, 2014 02:48 PM  | Hide replies

Kanwal Sibal is a seasoned diplomat. He knows well that we can only reap what we sow. We have given room for such action from the US Govt. It is not some ordinary Indian employee (many of whom are in the US who need maids from India at cheap rates but they are all law abiding Indians and so refrain from misusing the visa process. This lady and her family have defrauded the nation in the Adarsh matter and misued her position in the Indian Embassy instead of setting an example for others. It is strange that the former foreign secretary comes to support her instead of writing in favour of setting right the ongoings

Indian judicial system is an utter mockery in itself. It doesn't need Americans or anyone else.

Basically Mr Sibal is saying that US should also take 20 years for each case. If it tdelivers good justice so quickly then there is no time to escape for the criminals and fraudsters.

A reevaluation is needed
by subramanian on Jan 14, 2014 10:10 PM  | Hide replies

Kanwar Sibal has argued his case rather dispassionately in contrast to venom-spitting arguments by others. Now let me take issue with Mr. Sibal. 1. The T visa number that he quotes (one-third of the total 151 are from India) should be taken on a numerical basis. Because of the huge Indian population the number appears to be skewed. You have to view the number 50 in terms of a billion plus people. Perspective should not be ignored. 2. In Khobragade case the Vienna convention has not been reneged. She was a consular official and her immunity was restricted only to her consular functions and not for other activities. The UN adviser role does not give her full immunity. It was not processed by UN and accepted by the State Department prior to her arrest. The State Department gave her full immunity the day before the indictment. But that was only in recognition of her permanent appointment to the UN. The State Department action was taken only to get out of the imbroglio of the grand jury indictment. 3. Sibal's point about the total compensation such as housing, food, medical expense etc., is valid. But such an arrangement in the case of Khobragade was done only for the convenience of Khobragade. If the total compensation was to be taken into account it must have been specified in the contract placing a value for housing, food and other amenities provided. If such value exceeded the minimum wage it is OK from the diplomat's side but the US embassy must have agreed for that argument

To continue: If a value for housing and food was not provided in the contract to indicate the wage exceeding minimum wage it cannot be argued retrospectively. 4. The wages that the US embassy staff pay for their domestic help in India far exceeds the average wage (not just any minimal wage) that domestic help gets in India. You cannot say they have to pay US minimum wage for domestic help in foreign soils. You can only insist they comply with foreign laws. The US minimum wage in the US is not earned even by half the population of workers in India which would amount to Rs. 1.2 million. So talking about slave wages is out of question.

IT IS A COMPLETE DEFEAT OF INDIAN DIPLOMACY, KHOBRAGADE IS HUMILI
by subrata banerjee on Jan 14, 2014 04:24 PM  | Hide replies

Indian government and its foreign department took some stern actions primarily and taught USA in the right direction. But at last we the people of India feel shame for clean defeat of our foreign diplomacy and USA govt rediculed Kobragade by deporting her from USA. Now another 30 more Indian diplomats in USA is going to receive the same attitude from USA government because of the same reason. Our government must do some positive to restrain USA in doing so.

The argument that the US is not violating local laws by not paying them minimum US wages is morally hollow, as ......

As long as USA is paying more than the minimum wage or more than what the law in India requires them to pay, it is fine. The cost of living is lower in India than it is in USA. So, Indians are Ok to be paid at a lower rate. One should not expect the maid to make the INR equivalent of $8/hour ... that's how much an experienced IT professional makes in India.
