Sanjay help unload the second consignment of explosive and guns brought from Gujarat by Chota Shakeel hidden in a Van at his home.He moved out the police who wetre guarding his family and helped un load and be distributed the explosives. He knew the entire plot and was be a close conspirator.However he is a congress man and as such he has privilages of UPA 2 dushman party.

I am not a lawyer and would like an answer to a basic question in my mind...pardon me if this is contempt of SC. The SC Judge chided CBI, when they objected to additional time given to Sanjay Dutt to surrender, as to why they did not appeal against the Special Court's order exonerating him from POTA and found him guilty only under the Arms Act. Does not the SC Judge have powers to suo motu take cognisance of any such blatant omission and examine Sanjay Dutt's culpability under POTA, particularly when many other people with lesser crimes have been punished under that Act ?
