Rule is simple
If a 17 years old is capable of raping then he is capable of standing trail in the full adult court and punished accordingly.
if he has erection he is capable of having Saex.
17 or no 17, try him in adult court if found guilty then hang him for Rape and Murder.

Prosecutor should have discretionary powers
by Unapologetic Intellectual on Jan 31, 2013 02:20 PM  | Hide replies

You dont need to reduce the age of juveniles to 16. What if a guy commits such a crime at age of 15yrs & 11 months?

Instead the prosecutor should have discretion to charge a person upto age of 13 as an adult if his crime is very heinous. The court has to agree with the prosecutors decision for a juvenile to be charged as an adult.

That way, all 16yr olds dont have to suffer due to this single case & the law can still deal with brutal crimes of juveniles in a stern manner.
But our lawmakers arent expected to be that smart

This fake juvenile monster will move free just after 4 months when he attains the age ofa majora as perour rotten legal procedures. Juvenile Justice Board need to be scrapped and thrown into a dustbin after they have accepted a worthless school certificate based on the oral version his father. We don't need rules, acts and institutions framed by Britishers for their own safety.Where is the birth certificate which has became mandatory about 30-35 years before for getting admissions. I have also obtaine such certificate fro Mukhiya of my Gram Panchayat for admission of my daughter in Kendriya Vidyalaya about 25 years back. In this monsters case also Board or now Court should ask for a birth certificate to arrive at a final decision. In any case he should not be allowed to live or walk free of the jail or gallows. Or let other co juveniles in the Juvenile Remand Home take care of him by Bobitting him or kicking hin hard in the groins so that he becomes impotent for ever apart from braking his hands beyoynd repair. Otherwise India should wait and welcome another Jack the Ripper. Many Crminal gangs might be waiting for him with open hand.

BAN THESE ITEM GIRLS AND ALCOHOL FIRST.
by samudra blr on Jan 31, 2013 10:49 AM  | Hide replies

1.WE NEED TO PUNISH THE ITEM GIRLS AND ITEM SONG MAKERS IN BOLLYWOOD, THEY ARE TREATING WOMEN LIKE COMMODITIES.

2.ANOTHER REASON FOR SUCH CRIMES IS ALCOHOLISM, PEOPLE LOSE THESE SENSES AND THOUGHT WHILE COMMITTING CRIMES, THEY CANNOT CONTROL THEIR URGES UNDER THE INFLUENCE OF ALCOHOL.

3.JUVENILES ARE INNOCENT.JUVENILES SHOULD BE SHOWN A PROPER PATH, THEY NEED PROPER EDUCATION AND LOVE FROM SOCIETY, THEY ARE THE FUTURE OF INDIA. WE SHOULD SHOW THEM THE WAY.

PUNISHMENT IS NOT A SOLUTION, IT WILL ONLY RUIN A LIFE OF JUVENILE.

What about those who go to the cinema hall just to watch them.
aren't they adding fuel to the fire.
If there is no demand from the public there will be no item Girl or item songs.
producers and actors are only earning their living the best they know.
It is public whom is demanding and the suppliers are supplying.
Shun the movies those portray such item songs and scenes.
No demand and there will be no supply.

This obsession with age is alarming. What if the culprit was just days short of 18 years. Would he still be considered a juvenile? Seems his age was not an issue for committing rape and brutality but is a matter of concern only for punishment.

16 years was the law earlierr
by Arnab M on Jan 31, 2013 09:28 AM  | Hide replies

Earlier the age of a juvenile male was 16 years. In 2000 the law (Juvenile Justice Act) was amended to make it 18 years. Our corrupt politicians probably did this to protect their own sons who are usually notorious for criminal activities during that age.
I seriously hope that lady Ms. Altmas get her due share of treatment from a group of juveniles (all of whom are around 17 years and 11 months of age) in some dark deserted Delhi street. Let her defend those same juveniles then.

What a Question!
by vyas cm on Jan 31, 2013 09:21 AM  | Hide replies

Delhi gang-rape: Are our juvenile laws robust enough?

The questions should have been:

Are our Ministers robust enough? To consider making appropriate laws? Are they knowledgeable enough?
Are our MPs robust enough? To concentrate on administrative matters instead of self promotion and politics of the worst kind?
Are our Babus robust enough? To keep aside self interest, improper practices and non proactive measures?
Are our Citizens robust enough? To be able to take a stand stick to it? Like Gandhiji's non cooperation movement? The Nirbhaya episode seems like the only movement that has that has been resolutely pursued. Thanks to the womenfolk among us.

We are a nation of critics and opinion givers. Till that changes.......

This is my opinion. You are entitled to yours!

Lowering of Juvenile age
by satybir teotia on Jan 31, 2013 09:10 AM  | Hide replies

Few things are recommended:
1. The jhuggi Jonpadi in urban areas have entirely different culture as compare to their proximities in cities. The literacy level is zero in jhuggy jhopdy areas, their economy conditions are very poor. For the children of this area the life is exposed to all kind of decease which persists in illiterate societies.
2.The children of such ares have no respect for female child and they are the ones who can commit any crime at juvenile age.
3. Therefore, the juvenile age should be lowered to tackle the male children who come from such illiterate clusters. These children are very dangerous even at the age of 16 years.
4. Politicians probably uses such clusters for their purpose of getting votes.
5. They pay no taxes and vitiate the life of those paying taxes.

6. Changes are meant for making systems better so lower down the age to 16 years.
