Gujarat Lokayukta judgement makes CM redundant

It is commendable at the same time confusing when Rediff allows comments which are mere biased criticism without giving some thought on how one can appoint a Lok Ayukth in the States. The BJP have opposed the LOkpal bill on this issue of the appointment of Lok Ayukths in the States and wish to have their own laws to appoint LOk Ayukths? Is this a game being played?

Does the CM have a veto?

While one recognizes the need for the political leadership to be part of the consultation process, does he have a veto on the opinions of the others on the panel to decide the issue? With his record of controlling the home and police depts as well the judiciary in an indirect manner, his nomination did not meet the approval ofr the three others in the panel. We have a had a similar sitiuation ind the BJP lead Govt in karnataka where the Chief Justice's opinion was not taken into consideration and the nomination was nullified and the matter is in the Supreme Court. Why are the BJP alone trying to hide their corruption after the manner in which Justice Hegde preformed and charged the former CM and a few others of blatant acts of corruption. Can The "learned" Mr jaitley who has been advising these CMs find a solution without appropraiting unbridled powers to the CMs?

India is not a democracy nor a true federal system...the governing party at the federal level gets to impose its will upon other states by imposing its own "governors" on them.
These governors are loyal to their party bosses in Delhi, not the state govt.
It's time this system of governing-party-appointed governors be totally abolished!
Actually it's time the entire system was totally abolished...throw-out the outmoded Westminster model for something more like the US system, with a directly elected executive president who chooses his own cabinet and MPs can be legislators only...and no PM!

this is quite dangerous and awkward judgement, a big threat to Indian judiciary and definitely for Indian constitution. Reading news, This given decision by supreme court shows clearly the partiality and got the judiciary dead.

We do not understand either Constitution of India or Indian Law.They are hard copies.

What we see tody is only the soft copy easily manipulated by Madame according to her family's and then Party's convenience.

Whatever Constitutional authorities you have quoted are still relevant and are in place but they are her pawns.

And mostly your Party is responsible for allowing all this. You have not used your opportunities well.

mr. jaitly must know that lokayukta has to prosecute cm and other ministers, if council of ministers get primacy in appointing a lokayukta they will always appoint their slaves as lokayukta and hence no cross-checking of corruption can be done,that's why they are not willing to appoint an honest judge to be as lokayukta adviced by chief justice of gujrat.shame on bjp!!!!!!!!!!!!!!!!!!!!!

bjp is most corrupt party,that's why they dont want lokpal and lokayukta,remember they didnot let pass lokpal and lokyayukta bill by saying bjp ruled states don't want lokayukta as their cms have to be arrested like yeddiyurappa..........etc.

Everyone wants to be supreme. Not answerable or accountable to anyone.

In rajneeti (or to that matter any kind of management) there is no black and white, there are only different shades of gray.

Allowing one person to die to avoid a risk of 30% probability of 100 people dying is acceptable in rajneeti (numbers may change based on the person at the helm).

It is important for this person with supreme power to think for the benefits of the people. It doesnt matter he is called Lokayukta, Chief Minister, Prime Minister, King, Sultan or a dictator.

Having no one with these supreme powers or having an incorrect person are two sure recipes for a disaster. Unfortunately, today, our choice is between these two.

I have mulled over this. It is quite clear that the relevant law that allows the Governor to appoint a Lokayukta in consultation with the Opposition and the High Court has the intention of checking Government mala fide in not appointing or desiring a 'compliant' Lokayukta.
