Section 66A - Not Kapil Sibal

The Maharashtra arrests of two girls and the arrest of Ravi Srinivasan of Pondy for tweeting - both of these have been condemned as a "misuse" of Section 66A of IT (Amendment) Act 2008. I tried to see the history of this section from some resources. Minister Dayanidhi Maran introduced the Amendment Act in 2006. A.Raja was Minister (for Communication & IT) when it was passed finally, in Dec 2008.
The Expert Committee report for the Act has section 66, for hacking and other offenses. But Section 66A was NOT drafted by this Committee. Clauses a) and b) of 66A then were added in the Act (without the Expert Committee recommendation) when it was introduced later, written by someone. Then clause c) was added by A.Raja in Lok Sabha itself on 22 Dec 2008.
Lok Sabha seems to have passed the act without any debate.
Is it possible that the section 66A was deliberately added knowing fully well its "application" in this way, for censorship? Who, from the Ministry, added it to the Act? On what recommendation?
"Any person who sends, by means of a computer resource or a communication device,—
(a) any information that is grossly offensive or has menacing character; or
(b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will, persistently by making use of such computer resource or a communication device

This is the outcome of feeling threatened and the height of fascism. The congress govt is definately feeling threatened and its intolerance is showing up. Kapil Sibal is a lawyer and the genuineness and moral uprightness of lawyers as a class is already under question. Sibal is no different from other lawyers. I am just hoping that this congress govt is shown the door soon so that they would never ever come back to power.

Shivam Vij you are utterly ignorant to call a law of 2008 "Sibal's law" when Kapil Sibal became the Communications and IT Minister only in 2010. Get your facts straight before engaging in calumny.

It became a law in 2010 (after Sibal taking over). It was Kapil Sibal who engineered the Bill into a Law through the Parliament. Therefore the author is correct.

I think we are heading for Imperial Type of the Governance where any one who sp[oke against the Rulers was jailed.Good show,UPA> United Peoples' Alarm ( UPA) would dislodge such Governmwent soon.Hiope Mahatam Gandhi may come back to taech Governace of the kind he envisaged from the Congress when he ,against the elected Sardar Patel, was asked to amke room fior Nehru.Let the Ministry oof Socail Welfare highlight this fact as well .Why Jinnah was not accpeted by Nehru as PM of United India.He said to have negatived the4 suggestion of Mahatam Gandhi out right.Can some one throw some more loigvht on this fact which may also be distorted by the Cenatral Governmant as Incorrect.Let us find some witnesses /records to prove this.Thanbks.Jai Hind.
