Flawed decision

While releasing Binayak Sen on bail, Supreme Court observed that merely “sympathizing” with the Naxalite movement would not lead to the offence of sedition. “Can we call a person Gandhian just because a copy of the Mahatma’s autobiography was found at his home? Is it your case that having documents and pamphlets on Maoists and Naxalites at his (Sen’s) house (makes him an outlaw)?” the Bench poked holes at the Chhattisgarh government affidavit’s reference to the alleged recovery of documents and pamphlets from Sen’s house. He is also accused of having visited co-accused Piyush Guha 33 times in the jail, besides having “deep links” with the Naxalite leadership.

By the same token, if some suspected terrorist is found with literature to over-throw Indian government, material to manufacture bombs and is accused of visiting and having ‘deep links’ with terrorist organizations, say LeT, would Supreme Court grant bail observing that merely ‘sympathising’ with terrorists would not lead to acts of terrorism charges?

What about the cases of poor people & of low profile.
by Nitesh Thakkar on Apr 16, 2011 07:56 PM

Hon’able Supreme Court grants relief from the order the lower courts. What to the cases of the people who can’t afford the fees of the advocates of Hon’able Supreme Court or which are not of high profile?

At last senses prevailed..anyone opposing corruption is branded as Maoist !

Good that atleast we have the suprement court in the country which is trying to curb the menace of high-handedness of corrupt politicians..

I hope Binayak Sen will be more careful in the future once he is released ...

If you're from forward caste community you can be corrupt and escape from prosecution/punishment.
Because BC/SC/ST/Minority communities have no Reservations in Indian Supreme Court.

Who was the Ex-CJI Balakrishnan from Kerala who was most corrupt? He can get away because he is SC or ST. Check your sources. But sure, I WANT TO KNOW INDIA OBTAINED PERMISSION FROM WORLD BANK, UNITED NATIONS, GOVT OF CHINA, RUSSIA, BRAZIL, GHANA, IVORY COAST, EGYPT ETC. TO GIVE BAIL TO BINAYAK SEN? DONT THEY KNOW THAT THERE WILL BE GREAT CURSE LIKE TSUNAMI OR EARTH QUAKE ETC. FOR GRANTING BAIL TO SUCH A TRAITOR (WHO HAS BEEN HELPING ADIVASIS & ALSO GIVING MEDICAL TREATMENT) LIKE BINAYAK SEN, GODS WILL CERTAINLY PUNISH INDIA. GODS CAN NOT PUNISH A RAJA, MANMOHAN SINGH FOR BEING RAJA'S STOOGE, SURESH KALMADI, KARUNANIDHI, YS JAGANMOHAN REDDY, ETC. BECAUSE THEY ARE TOO STRONG & CAN EASILY GET MAJORITY BOTH IN HEAVEN & HELL & ALSO BRIBE BOTH GODS & DEAMONS & NO ONE CAN ARREST THEM.

Patriots or parasites?
by Onlooker on Apr 15, 2011 03:32 PM

For some privileged people mainly from a community who suppressed others for years and years, united India means more land for themselves and more people to feed on. United India suits their parasitic living. They simply don't care what the downtrodden and marginalized people go through day in and day out. The real patriot who fights for such people rights ends up in jail. Is this how it should be in a democracy?
