Case against judiciary of India

Case should be lodged against Judiciary of India for such bloody delay in Bhopal gas tragedy.Such a big incident 25years back and still CONFUSED to give verdict!!!!What the hell is this??How many cases of poor Indians may be pending in courts???It's real shame to all PMs who came after this tragedy and couldnt solve it.Let this case be dissolved instead making irritation and wasting time.CPI-M please find some other fresh issue please!!!or else start a mission to clean rivers of India or fight for cleaning of steets of India.That would be a better work.

While we probe what happened in Bhopal 26 years ago it is indeed shocking that we still do not have any law that can deal with such a disaster.

While we are debating the various clauses of the IPC what we are not arguing is a law that can deal with such a disaster.

For the past 26 years, parliamentarians of all parties have been unable to table a bill that can deal with such a disaster effectively. This indeed speaks volumes about the capability of our esteemed parliamentarians.

Any modern democracy have laws which deals with these kind of disasters. However, in India our political parties are busy scoring debating points while skirting the real issue of corporate responsibility.

I sincerely hope that in the next 26 years our parliamentarians will come up with a law that will protect Indians from such diasters.

Selective Amnesia Nearly 17 commissions were constituted after the Malegaon and Ajmer blasts, but for a tragedy that killed thousands of persons, no commission was constituted till date for ensuring imprisonment to those behind it Arjun Singh was then CM of MP State.Surely he can not hide under the umbrella that he was told to help Anderson escape.Even in Army a person has the right to not to obey an unlawful order.If Arjun Singh was really bothered about all those thousands who were killed in Bhopal least he could have done was to resign from his poat of CM instead of making the accused esacape.

Vienna convention of IAEA clearly provides for limiting liability to the suppliers. This is a wise technology policy which encourages innovation while transferring responsibility for proper technology acquisition and operations to the operator. This detailing of Caveat emptor is sound legal principle.

Indian nuclear liability bill needs to be synchronized with Vienna and Paris conventions and ideally be applicable to all nuclear power plants irrespective of ownership composition. This would set a healthy precdence for such law making in industrial and environmental domain.

Left have good record in assisting law making to protect labour rights and have participated in ILO talks. The Left-liberals spearhead Indian environment friendly Green movement and have joined hands with their fellow idealists in Greenpeace and other NGO efforts. To provide guidance for Indian industrialisation, it would be better if Left leaders opt to cooperate with UN affiliated bodies in an atmosphere of mutual trust, and prepare ground for such informed consensus within India. It is likely that given well reasoned point of view, Mr Karat, a person imbued with sound intellectual integrity, is likey to pursue a rational and reasonable policy.

Left leaders, need to follow example of late Jyoti Basu and have a soft corner for professional managers. The softies do not fit into dynastic INC, nor vituperative BJP, nor anti-market Left. Providing about 2 bigha of legal-social space is all they expect.

When an issue gets politicized, the political consensus depolicizes it. Such depolitization has normally taken place in security policy. It needs to take place in all technology policies as well.

Technology and security are deeply interrelated policy issues. An uncompromising stand in one can have ramification on the another.

You may be right..bu I have very very little trust in the Indian Govt and specially the congress govt...they would do anything to stay in power...even sell our interest and lives of its citizens..(which they have done in some cases already)....
and the Bhopal case is a typical case, where the govt literally sold out for foreign powers..

I don't think so. UC paid 750 million dollars in 1987. Lets say due to Indian inflation rate money doubles every 8 years so that is equal to 2 billion dollars as of today. Convert that to rupees and it becomes 9000 crores as of today.
So, in my opionion, I feel the Indian government extracted its pound of flesh from UC but it never reached the victims. And as we know most of the victims were slum dwellers. I feel there is no point in cursing America, it is our politicians who are worse than dogs.

Nuclear liability bill has presently become the lodestone of Indo-US relationship, hopefully it shall become a stepping stone to deepen relationship with all OECD nations.

The real need is to make it consistent and in conformance with the paradigms and principles of the Vienna and Paris conventions of IAEA and all future IAEA sponsered agreements.

NLB would be applicable to not just US but also any future investments in nuclear power from France, Japan and even Russia. Ideally the same agreement ought to be applicable to all domestic investments. Making this liability provisioning independent of the composition of ownership would be a healthy legal precedence, it shall set the tone for legal guidance in all industrial and envrionmental law domains.

Left have played a pathbreaking role in evolution of labour rights in India, and left-liberals dominate the arena of environment friendly green movement. They have consistently worked with their ideological brethrens in ILO, Greenpeace and other international agencies. There is solid ground for an amenable consensus on this crucial technology policy.

Legalising exemption beyond specified limit is indeed provided for suppliers in Vienna provision, but this is not applicable to Bhopal Gas tragedy where UC were the operators themselves.

The onus on operators is a wise technology policy, encourages innovation as well as operations discipline. One who opposes such policy, needs to reflect deeply and seek sound advice.
