Why fine the Maharashtra government?
by vorpal on Dec 15, 2010 04:25 PM

If you fine the GOVERNMENT, ultimately it is the people that pay. I wish the Court had ordered Vilasrao Deshmukh to pay the fine from his pocket... and the amount should have been Rs.10 crore.

and neither he nor his son is paying the fine. The government is paying. That means, the honest taxpayer is paying.

Vilasrao fined
by Anil Kulkarni on Dec 15, 2010 09:46 AM  | Hide replies

With utmost respect to the Apex court I am constraint to say that the order is absurd. Whatever Mr. Vilasrao has done is done in his individual capacity taking disadvantage of his official position as Chief Minister. No duty of chief minister entails the incumbent to coerce the comman man to such low level crimes.
The court should in all humility order Mr. Vilasrao Deshmukh and the concerned officials engaged in the said activity to pay this fine from their own pocket and save the Government and tax payer from paying the fine. This order will form the wrong precedent in the sense that any CM, minister or official henceforth will do all illegal things and the poor tax payers will have to foot the bills of such nonsensical acts. The state should not have any vicarious liabilities in respect of wrongful acts of the ministers done not in the course and out of their duties.
Some activist should file a revision petition for getting the order chaged. I am sure the court will definately understand the wrong done to taxpayers and will correct the same.

The fine is imposed on the govt. The criminal offence is committed by the minister and said collector. The money must be recovered from DESMUKH otherwise let them face criminal charges as per CrPC.

Politicians

they need to be put into the dra1nage. Huhh just 10 lakh rupees fine and that too on the state government, why not directly on the minister itself? There should be a criminal case against the political criminals.
