Optimism
by Girish on Oct 07, 2008 12:29 AM

I know someone who in discharge of his official responsibilities blew the whistle on a conspiracy bleeding hundreds of thousands of rupees of Govt funds ,and was terminated for this reason from service for his pains.

His efforts to have the malafide order set aside in court were successful in the first try , but on appeal by the panicky authorities(the senior management and the entire board of a public sector corporation , including a govt secretary), the division bench of the court , including a celebrated and widely feted judge , preferred not to go in to the merits of the case (ie the whistleblowing incident) but passed orders allowing the termination from service.

It was a real pity that the perpetrators of a crime went scot free and the whistleblower had to take the rap .But still , its probably better to be an optimist ,after all.

A pure tamasha by those involved in dramas!

I am posting another one as my candid first one may be removed for abuse! There are more than 1.25 crore cases in different lower courts. High courts are proud to have more than 10 lakh cases. SC more than 45000 cases. So most of us have experiences with these courts! After politicians, we do our most dramas in the judicial system. Few trust any of the judges/justices! So the most effective way on the usefulness of this judicial system, will be to ask any one on the street and see the reactions one gets.

the judicial system in India is broke. Lower judiciary is totally corrupt and the best legal brains refuse to be elevated to Higher Judiciary. That leaves us with mediocre guys satisfying their egos in being addressed as 'MY LORD'I know of one case where a govt.counsel was elevated to the High Court by gratifying the Chief Justice of that High Court, later making a corrupt Judge, but as there is no cretaria other than date of elevation this gentleman finally made it to the post of Chief Justice of a High Court. In another case a brief less lawyer was elevated just because his better half was active in the party circuit of Judges. He also made a spectacle of himself, but continues to be an Hon'ble Justice.Another glaring example is of a judge of lower judiciary who was reported as not being fit to be retained in service being elevated to the same high court on the recommendation of the new CJ.Judges of Higher Judiciary are brother judges and are answerable to none, leading to the mess in this country Cases ready for final hearing are not heard for twenty years, the lower staff at high courts do not list cases unless their palms are greased. What justice can we expect. It's a dead and corrupt organ of state only for the rich and the powerful.

A whitewash tamasha!

First Indian judicial system is broke! Criminal and rape case convictions 7 percent, terrorism 2 percent. Times: well children or grandchildren can take the judgment. There is no accountability in judiciary. We need a judicial commission to conduct enquiries into judges and appoint of justices! If this Justice B N Srikrishna is one of the attendees then one can imagine the outcome. This person got his promotion with recommendation letter. A lady owner of the Marathi paper did not apologize and she preferred to go to jail in this case. Most of these frauds threaten anybody writing truths under the contempt court! Slowly due to the habit of pushing even the most stinking dirtiest acts under the carpet, majority of Indians have now have only contempt for courts and judicial systems. If you don't believe look at different polls.
