It is injustice system and not a justice system!

There are more than 3 and half crores of cases pending in different courts and judgments come after many years and in some cases after death. In Harshad Mehta's case, SC Justice Sri Krishna gave judgment one year after his death! SC gives bails to convicted terrorists such as Sanjay Dutt and Memon relations. While more than 45000 cases are pending in SC itself, is this bail petition more important than others? Does not this SC has any other job? Politicians, rich and famous have one set of of laws. Constitution and laws of the land have been reduced to: bring the person I will quote you the law! What are these winter vacation, summer vacation and more vacations? Are we being ruled by colonial masters? On what basis, these judges and justices, who hardly work or do tamashas for 160 days, cry/scream about shortages of judges? Whom are these people fooling?

In most of the democratic nations, one is innocent unless proved guilty “beyond reasonable doubt”. In India, this “beyond reasonable doubt” is twisted to mean “beyond any doubt.” If one is not able to do/study anything (with a few exceptions), then one takes up law. Here those who don’t have much practice become judges and justices. In many states, there are rates for becoming judges too! The same is reflected in all courts across nation. There are bail rates in most of the courts! So even after murders, worst terrorist actions, one can see culprits getting bails between long trials. Some of these trails are creating world records! In courts, good lawyers twist the words and cases so badly to “beyond any doubt” that over awed justices free a good amount of them, there are notional sentencing and then bails between next appeals. Here SC CJI is the worst offender by giving bails to Sanjay Dutt, Memon relations, Monica Bedi and more. Conviction rate in terrorism cases is two percent! If terrorism, murders and rape and murders are low risk business, are not the judiciary and laws guilty beyond all doubts?

It is already well known that Pak is terror country. Why play same
ranting on same old stories and fool Indian public specially when
we are not able to control our own known problems of traitors.

1) In India one can get a passport from offices for 20k Rs bribe.
1000s of fake passports to illegal foreigners (from Burma, Pak, Srilanka,Bangladesh) have been issued.

2) Army personals would let any truck or consignment get in border for exchange of
1 lakh Rs.

3) Custom officers on any airport/border will let smuggler's goods in for few thousand Rs.Immigration officers also cooperate.

4) Police in India is well known rotten lot ( almost 98%) who would sell us for anything from 1000 Rs & above. 100s of Mumbai police are indirectly working for Dawood else how would he run his empire.

5) Politicians R known for killing us for votes& swiss accounts.

6) Any authorities eg. customs, excise, income-tax, RTO, MTO, police would do anything for their pocket .(see recent income tax comm.in bombay)

7) Army and police are openly involved in looting & raping innocent people on border states.They r the one who forcibly create terrorist for country at our cost.

When America did not face any attack after 9/11 then how India has multiple attacks, it is coz our traitors from govt offices and politicians,who make noise & hysteria for few days to fool public just to show they r working. but in reality we r killed by our own gundas.

Because of corrupt , pathetic judiciary criminals are flourishing. What we can expect when judges ask for bribe?

Judiciary is partly responsible for repeated terrorist attacks!

Indian judicial system, especially CJ, is partly responsible for the repeated terrorist acts! Conviction in criminal and rape and murder cases: 6 percent. Conviction rates in terrorism cases is hardly 2 percent. The trials can go on for ever. Meanwhile many get bails or freed on most unusual/technical grounds! Let us take the case of 1993 Mumbai blasts. The most glaring example of laws bowing before rich and famous is that of Sanjay Dutt. In 2007, Sanjay Dutt, Memon relations and some were convicted in the lowest court. With more than 45000 cases, how SC CJ’s bench found time to hear and give bails to Sanjay Dutt and Memon relations? Bails were sent by e-mails!!! Was this the most important case? Are there no courts in between? In Sanjay Dutt and Memon relations case, ASG supported the bails! Terrorism convictions in the US, UK and many other nations are as high as 90 percent! 9/11 and London train blasts were the last ones in US and UK. Many European nations also preempt most of the terrorist attacks. How many are being prosecuted in terrorism cases including disgraceful 2006 Mumbai train blasts? 26/11 is an international disgrace and we have become a laughing stock all over the world!

This post is the reply for those 19/20th century who talk big like “constitution”, “impeachment” (no impeachment done till now), “contempt”, “equal treatment of law”, “due process” , “jail” and so on! There are some basic principles of democracy. From these a constitution is derived. In Indian context, our constitution makers borrowed mostly British system with some tinkering to account for our conditions! Since then there have been huge number of constitutional amendments, not heard of in any democracy. So we have retained shamelessly the British dress codes (suited to cold countries), the vacation systems (suited to rulers) and conventions!!! Contribution of our judicial system has been gross misuse/abuse/rape of all laws enshrined in the constitution! UP PF scam where judges took bed sheets, bed covers from the Class IV employees PF speaks volume of the stinking corruption/abuse! There is a SC justice, 11 HC judges and about 20 lower court judges! Now our CJ, who has billed even his private foreign tours on govt money (our taxes) is talking of impeachment (no impeachment made in parliament till now), zero tolerance for corruption and so on despite best efforts to stall the investigations in this scam. On RTI, our CJI mentioned that he is not a public servant! Then who is footing his bills? Current CJ is responsible for protecting the corrupt and criminals in the judicial system. Most will deny! But it is proved beyond doubt from most of the actions, that it is so!

Every one is afraid of taliking about this because one does not know which may be contempt of court and which is not. Judiciary's name is appearing and taliking about corruption in judiciary is of recent happenings. Anyway, some thoguht provoking exrcises can be made on this issue. First of all, steps should be taken to reduce the backlog. For this purpose there should be enrolment of people qualified in Arbitration courses and willing lawyers who want to arbitrate and also enrol the entire retired judiciary and get their helpt to reduce the backlog. Having passed amendment to Section85 of CPC efforts should be made to refer matters to the Arbitration and take their opinion in passing the judgement. Cases which are pending on account of plaintiff for more than two years should be disposed based on the counters filed. Cases which are pending on account of the defendant, should be disposed in favour of the plaintiff since the defendant has nothing more to add to the counters he filed earlier. In this way entire backlog can be cleared. The judiciary which retires on account of superannuantion should be continued on consultancy basis and clear the backlog. Grameena Nyalayas should be given all the case which came from villages involing the properties or matters pertaining to their village and dispose the cases speedily. Gramena Adalats shuld be set up to clear the mutually comrpomising cases.

Our judicial system could not win the confidence of people, it needs drastic reforms, even at grass root level. Even criminal cases take about 5 years to solve. what to tell about civil cases.
