SC Judge's refusal to hear
by kunuthur srinivas on Mar 18, 2007 11:26 AM

The persons occupying the seat of Justice should not be overtaken by emotions and happenings while performing their duties. In this context, the Steel Heart of India Sardar Vallabhai Patel did not leave the court when message was conveyed to him about his mother's demise, when he was arguing a case in the court. He left the court only after he finished his arguments. This should be the spirit with which A R Lakshmanan should have demonstrated befitting his seat of justice.

How can you be so rude in commenting. The judge has almost finished his spotless career and now becasue he got such a threat of life, he just withdrew from the case in legal manner.

The SP people can go down to any extent, that is clear if you know about the ground realities of UP. It has taken a toll this time in the form of the SC judge.

Timidity
by sunilkumar mishra on Mar 16, 2007 11:10 PM

This is absolute timidity and stupidity for such a senior judge occupying the honourable seat in the highest court of the land who could make such a funny scene in the open court making mockery of the highest court. This could be clever ploy for the judge to take excuse under crocodile tears for coming out of the high profile case. Such kind of conduct tantamounts to huge dishonour to the Hon'ble Supremne Court' standing and reflects very badly on the quality of judges we have even at the highest seats of justice. Law and justice are not safe in these hands and brains due to their pliability and susceptibilty to fall from justice with little arm-twisting. Surely Our highest Court alongwith the billion of Indians do deserve such judges who are firm with their convictions, strong with their integrity, matured with their rational judgements, unwavering with their strength of their intellect.

You have no idea what you are saying, the open source movement is backed by anti Microsoft folks and corporations (IBM, Sun BEA), they loan their devs to develop %u2013 90% of open source projects are done by these big corporations that cannot compete on features and rich interactive software so they try to build a movement.
have you seen office 2007 %u2013 open office can%u2019t even compete on features 10 years from now %u2013 by than you can be sure office 2017 will be so much ahead %u2013 do you know the pitch for open office %u2013 they say that you are dumb and will not use the rich features so don%u2019t use MS office %u2013 what kind of crap is that %u2013 it is like Indian politicians who would not provide basic amenities to the people in India and talk about India becoming the next super power.
no one is dumb %u2013 it is a capitalistic world if open source is so much better than people will adopt it anyway, no one can force Microsoft in the open economy if it was not for the good tool sand technology with innovations they have been doing. Do you know the Germany Linux deployment is still going for last 5 years and there is no light at the end of tunnel %u2013 they have already wasted so much money that would have bought them more than 10 years of Microsoft licenses, this is happening across the board - there are so many studies that would show the tco is so much more on open source than windows.

well check www.ubuntu.com based on Debian Free Software Guidelines, even though they might not be able to compete why is Google funding and forking Ubuntu to create Goobuntu OS,it might be for competition but the source code is free under General Public License, and thus anyone can fork it out and develop it,so corporations cannot hide their source code,it flows out, secondly in all Linux distributions Ubuntu is said to be the best, see it's ratings on distro watch for desktop market, and well it's free for now, what about microsoft,it's goddamn costly and they are monopolistic as well and hide their source code under copyright, what about viruses coming into windows??? well if company runs it they cannot patch vulnerabilities so quickly,Red Hat charges under GPL but Ubuntu runs under GPL as well as Debian Free Software Guidelines so it's free and it's good too!!! and if they do start charging someone else might fork out and create their own OS so no market domination!!! check www.ubuntu.com and I assure you it's as good as Windows, the only Linux that can really compete

it's funded by Canonical Ltd. not Sun Microsystems,Sun has it's own OpenSolaris and no one wants it,it's awful,Microsoft is good with it's look and feel but as such it's the most vulnerable and at the same time damn costly!! ok some old destroyed corporations started releasing their source code under open source licences but Richard Stallman the man who started it all came at a time when Microsoft was still struggling and IBM and Apple were the big giants, so linux kernel is what was created by Linus Trovalds independently funded by yes some corporations but at the same time by enthusiasts and students, similarly GNOME wasn't created by any corporation,it was started by two independent engineers in Mexico, soon big corporations losing out to Microsoft realized that they had to capture this opportunity so they started releasing their source code under General Public Licence, but as far as it goes,no one was successful not even Red Hat because they were charging money for it,so people developed, they hosted and people bought it from them, and then came the Mozilla Firefox revolution , source code of Netscape Communicator released under Mozilla Public Licence and then General Public Licence and Lesser General Public Licence and finally Ubuntu based on Debian Free Software Guidelines, this is a free operating system, one can order a free copy from their site www.ubuntu.com and it's the best for desktop and has a good user interface compared to others. You can have both windows and ubuntu on the same system, you just need to boot and partition it into 2. or else get 2 harddisks and install windows on one and ubuntu on the other.

A crying judge...
by sree on Mar 16, 2007 09:20 PM  | Hide replies

.. is unfit to be a judge. India's bane is the judiciary. They do everbody's job exept their own. They decide who should be navy chief, what CBI should do and whether India should talk to naxalites or not.

A judge should not enter the picture until a law is alleged to be broken. India is the only country where a judge rules the country without any accountability.

Think about it.. even the worst politician has to answer to the people once every 5 yrs (sooner nowadays thanks t ocoalition politics). But once a lawyer passes the bar exam in his early 20's, does he answer to society at all?

They wont even declare their assets! What are they so afraid of? and if anyone questions then, CONTEMPT! (remember arundhati roy?)

Death to JUDIOCRACY!

The worst govt given by Laloo is better than the best govt given by Balakrishnan Pillai - for that is democracy.

And for those of you who are going to argue that "politicians are not working", that is not an acceptable reason. That way, the british were FAAAR better at governance than anything we have produced. Should we have kept them on?

I repeat: The worst govt given by Laloo is better than the best govt given by Balakrishnan Pillai - for that is democracy.

It is very easy to say such things that the judge is bad and death of judiciary blah blah. Its very difficult to bring people like Mulayam to court and punish. What happened to Manu sharma ? Do you think its possible to punish an "evil" like mulayam so easily ?
I have full faith in Indian judicial systems, only thing that we people have to keep on putting pressure on system and be united in raising voices.

Ashish,

1) It is also very difficult to bring Islamic terrorists to justice.. even if we catch Afzal, see what happens to them! So, according to your logic... (please complete your own sentence)
2) I said Death to Judiocracy (Rule of the Judges) - not Judiciary. I hope this was an oversight on your part.

one of the reason that the country is not wild west is due to judiciary which is still functioning inspite of all sort of interference from the government as well the so called elite and educated.

Anesimo,
One of the reasons our country is still an underdeveoped east is because of the bad habit of going to judiciary for all our problems. In a democracy, people not only get what they want, they also get what they deserve.
