provisions in the evidence act are time tested and are fair enough to try an accused. cross examination brings out the truth eventually.
narco test cannot establish innocence or otherwise of an accused. in a drug injected semi-conscious state doesn't intend the consequence of what he says. a.k.upadhyay

Well said my friend. You said in simple and straight words. Wish such things never happen in our country or anywhere else.

Dear Friend It only shows your immaturity that such issues can create a bad name. Bad name comes by issues like Reservations for elite people. Reservations for people like Atal bIhari Vajpayee, Sonia Gandhi, Laloo Prasad yadav, Somnath Chatterjee.
The issues of Nithari has to dealt by these very people who temselves are involved Like Mulayam Simgh and Sonia Gandhi who are ruling State UP and Centre
Please donot get Swayed but speak openly aginst real culprits like Sonia Gandhi, Atal Bihari, Abjul J Kalam, Somnathy Chatterjee who are holding the country to ransom by not adhering to constitutional Means
Narco Analysis Test can onle be admissible in the Court of Law if it is supported by some recovery of weapon or other things, Things which are not known to the Investigating Agency and is unearthed after the statements of the Accused, on whome such tests are conducted, then only such part of the statement can be admissible. Ramesh Agarwal Advocate & Central Govt. Counsel Orissa High Court, Cuttack.

i am really happy with the people replies that we should definetly put our corrupted politicians on nacro therapy? But I am amazed that why D.P. Yadav son was not put on this test or Manu Yadav?
OK - is it just me... they're administering a cocktail of drugs with potentially harmful side effects - how on earth can this be permissible under the law. If the dosage is incorrect, the person can go into a coma or even die. Why don't they just torture the person (in this case, however, that would be a good thing) instead...? First I've heard of a process that deliberately puts a person's life at risk to get dubious results - anywhere else this would be a violation of human rights. (In this case, they should do the worst possible, though - the argument above is for other cases where the crime may not be that serious, such as whether the son of a late politician did or did not take drugs - yeah, let's find out by injecting more drugs into him...) Any lawyers don't know whether or not this is admissible - goes to show how much law these so-called lawyers know - probably school dropouts who managed to buy a certificate from somewhere. Not admissible!

My dear i think ur brain system has gone CRAZY. Narco analysis was first done in other developed countries followed by india.Wase dekha jaye to police ka dose jyada hone se bhi insan coma me ja sakta hai ya mar bhi sakta hai. Same with narco anlysis my dear....DEPENDS ON THE DOSE.

well hello, first things first... i totally agree with AbyB that the tests are a violation of human rights and "Dear Mr. Agarwal" please note that you are taking a view that the guys committed the crime, even before the same has been proven. While I am of the same opinion, the fact remains that no law should allow this kind of tests to be carried out on people. What if these guys die and are later proven innocent? It does not matter if you are an advocate (or adocate as you say) in a high court, what matters is whether you can think logically or not. so please don't try to throw your degree in our faces... some of us may have better degrees than you!!!

Are you favouring the criminals? any test, any method, any torture is nothing for these criminals. The police should be free for any torture to revel the truth. How can you talk about Human Right for them? Do you still beleve that they are Human? What they were doing does it comes under humanity?

My Dear Friend of which violation of Human Rights you are talking off ? In favour of a person who has raped - Killed -and then again raped - and then ate the kids ranging between 5 to 11 years of age. If you are talking of mercy and violation of Human Rights for such persons - then I vow to you as you are a saintly person or Jesus. Regarding admissibility of such tests, I have already posted my views, you can see that. Ramesh Agarwal Adocate Orissa High Court

My Dear Friend - thank you for your comments. If, however, you care to read the rest of the post, you will see that I am not advocating any mercy for these monsters. I am merely making a point about so-called narco-analysis. I do hope you at least read your briefs fully before jumping to conclusions...

You can ADOCATE at will if possible but you better not advocate if you presume the accused as criminal.
