Contd Time for a TRUCE
by Neo on Nov 01, 2006 04:55 PM

Contd from my previous Post - Time for a TRUCE.

Now the Solution/TRUCE should be that the Govt and the Traders should sit alongwith the Reps frm Judiciary and Tell them the strengths and weaknesses of their cases. In other words, if the traders dont compromise, their other bad habits like tax evasion, stolen electricity etc should be put on their face.
Similarly, the govt should be made to realize that whatever has happened, they have an equal hand in it. and they still do as the corruption is still prevailing. So both sides have something or the other to be tried for. Why not fix both the ends and go for a TRUCE with a practical Solution.
I know its a long post. Hope someone understands what i mean to say.

Its time for a truce
by Neo on Nov 01, 2006 04:51 PM

Hello All,

I think its time all the parties sit together and look for a truce. The fact of the matter is that no one (govt, traders & judiciary) are innocent in this issue.
Govt. - Where was this govt when their own officials and Babus took hefty bribes from these very own traders for keeping the business going. Whether it was a one time bribe or a regular entries to the bribe cash registers, the babus enjoyed all the money and took benefit frm the power they had.
Traders - Now, the very traders who are staging these protests on the pretext of their Rozi Roti are not innocent enough to be spared. The are equally (and i wud say more responsible) for the current situation than the Govt. A person who gives the bribe is if not more but equally responsible for the crime than the one who is taking it.
Also, consider the other ways these traders are still duping the govt. Think about TAX EVASION(service, Income, VAT etc), Think about all the power theft they indulge in. Some are actually paying as per Household energy rates while they shud be paying as per commercial rates.
Judiciary- The fault frm the Judiciary's end is only that it STILL FAILS TO SEE THE ACTUAL SITUATION. Contd.

sealing in delhi
by Ramdas Iyer on Sep 20, 2006 08:48 PM

There seems to be a lot of terror in delhi regarding the sealing. Honest people who have bought houses with little extensions in their balconies and bedrooms are feeling threatened. It is the duty of the elected government to protect its citizens from terrorism, whether it is from across the border or from the courts. One buys a house to live in peace. If one has to live every moment of his life having mortgaged his life to banking institutions in fear of judges, then the government is redundant. Each arm of the government, the executive the legislature and the judiciary plus the press has its own role in ensuring the safety of its citizens. None must take over the role of terrorising Indians. Raping and murdering several girl children is one kind of crime and fitting a western toilet in ones bathroom in place of an Indian one, to accomodate the needs of elders is another crime. If a judge confuses himself betwen the two then it is he who needs to be re-educated, not the citizen. If the government chooses to hide behind the gown of the judges, then it will pay. When the British judges banned salt production in India, Gandhi showed us the way.

COURTS AND GOVERNMENTS ARE EQUALLY RESPONSE FOR THE DELHI TROUBLE
by rcpillai on Sep 20, 2006 08:38 PM

Everyday, everywhere,we are getting news, not only from Delhi, but also from all other cities, including Mumbai, Kolkata, Chennai etc. encroachments officers with the help of law enforcing officers are from time to time demolishing the structures constructed illegaly by the builders / occupiers etc. There are also some type of actions from authorities to demolish underground leaders properties as well.We don't understand why this is happening and where were these authorities when these illegal constructions are constructing these buildings / shops etc. We do not feel that indviduals will construct such type of buildings, but builders and other high rich people can construct it and sell it to middle class people / low income groups etc. Instead of wasting lots of money by demolishing the illegal structures already constructed in various cities, Indian Courts has to instead ask the Govt. to take over those illegal constructed buildings and running Govt. offices on those buildings, because we knows that number of govt. offices are running on rental buildings. If it is residential buildings, then Govt. officers accomodation can be arranged on those buildings. Don't waste public money!

IN a democracy, will of people is Supreme
by Pradyumna on Sep 20, 2006 07:51 PM

In our country, normal needs of ordinary people are bloody too difficult to meet.
(1) IF you live in a city, govt will not give you drinking water. You HAVE to dig out your own water using a borewell, BUT, it is said to be illegal.
(2) Govt will not provide electricity, but in several areas, running DG sets is illegal.
(3) Govt will not provide with security, but keepinmg arms is illegal.
(4) Govt will not provide with jobs, but begging is illegal.
(5) Govt will sell off land at cheap rates to builders who will construct the houses against legal norms, raise the price of the house to 10 times actual cost to suck the ordinary people, only to be declared illegal and demolished. Also, corrupt govt officals of municipality will go unpunished.
(6) In the name of development, Govt will build dams with outdated technology after submerging entire communities and cities and not pay any compensation at all. The money will eventually find it's way into the pockets of developemnt officers.
(7)Every act of poor people is illegal but even murders and gravest crimes committed by politicians is legal.
(8)Courts are color blind, they see only black and white.

Sometimes I wonder whether Metro services should have actually been started in Delhi.Calcutta also has same services but I never have heard or read that mobs there throwing stones at the Metro service. It is so pathetic that the delhiites don't have a sense of pride in such services which make it unique.Hooligans keep damaging our properties and the tax payers keep shelling out money to repair the damage. And you know what, someone is going to give excuse about why they did it.At first, they illeagally start things and when their illeagal business is being stopped, they start crying foul and start destroying public property.Well,I don't understand why should this nuisance be tolerated at all.

by sudhir suri on Sep 20, 2006 04:53 PM  | Hide replies

The govt must ooperate with the courts. For the sake of votes ans 4 lacs traders in Delhi ,the Govt must not let down the judiciary. Millions of Inians look upto Govt to uphold the judiciary.
Every trader has a record of cheating govt and consumers, then why the sympath y for traders.

Yes law must prevail and everybody should be punsihed. You can't start an illeagal business and go on justifying it.Criminals make their bread and butter by breaking the law.Should law allow them that just because they have been doing that for XYZ years. It is such a fantastic excuse by talking about bread and butter.A petty small time criminal, who is uneducated ,steals or breaks law.Should law turn a blind eye to that, because he is poor?????There is no justification to break law.Ignorance of law is not an excuse but a personal fault.

Supreme Court should be gheraod and these judges should be brought back to the reality are they blind when they give judgement. they are snatching alongwith sarkar govt. the roti from the mouth of people. only 23% are living in posh locality for them they are doing this . is this equality. and every body is equal before also they are acting in partisan manner. illegal colonies are next target when these were growing r they hatching eggs why don't they penalise these civic agencies and big political fish. there are other issues in delhi which are to be redressed why don't they go for that. tell them either they should ask govt. to provide everybody employment and housing then see the dream to make it paris. what they have done so far in reservation issue in mandir issue they don't have work all are against of most the people the country. when they are talking of equality how equality remain if you snatch the roti and roji from a person u r rather compel to become criminal why not these judges, advocates are understanding these simple funda of life.for that not to be read much ipc and other crpc's.what they havedoneso far since 60yrs of ind.they were failed to provide law to evrybody

Absolutely right you are, it is not happening in delhi that politicians are taking away the right of employment, even in remote places like canacona in goa,and many other places it is happening, that this present govt is not alowing people to earn their living.this country have more then a billion people what you need?employment or just empty roads where people starve to death.people should be allowed to do business what ever means they choose.change the bloody constitution, these politicians created this mess when education was not provided since independence.
These media and politicions are hand in gloves.
if you notice more then 500 years old park with rare species of fruit and ancient plants in kanpur up were sold for peanut to this danik jagran group.for malls. just see comissions.they are thugs ruiling.

At last, someone has the courage to speak up! Thank you, SUPRATIK.
The SC says, govt wants to convert the whole of Delhi into a market. The way "sealing", and especially demolitions (arbitrary and/or selective) are going on, Delhi will soon look like a city hit by heavy bombing in a big war. Residents of flats are especially helpless against the mindless vandalism. The pity is that they are mostly peace-loving, law-abiding citizens, and incapable of reacting like the traders have done on Wednesday. At the same time, it must be noted that it is UTTER DESPERATION that has driven the traders to react the way did, and they are not really violence prone. In TV news, I saw a policeman firing at people from his revolver. It was terrifying. The actions of MCD, DDA, and the police can only be described as redirected -- and misdirected -- fury. The MCD and DDA officials have been castigated by the courts for their corruption, and they are taking it out on the people now.
Lastly, does it not appear that the judiciary has taken over the functions of civic administration? Is it justified?
