Innocent until proven guilty is the rule under a functioning criminal justice system.

Apparently Indians have the view that a functioning criminal justice system does not currently exist in India. An impression exists today that India is ruled by mobs and not by laws.

Indians are now resorting to a tribal sort of justice, where the accuser, prosecutor, judge, jury, and executioner are all merged together.

Absence of a criminal justice system leaves people with no option but to go for tribal justice.

If anyone wants to change back to the Innocent until proven Guilty rule, they would need to convince the people first. It probably requires showing hard proof that there exists a functioning criminal justice system.

It is difficult to imagine such hard proof being possible in India today, where rule by mob is the tacitly official doctrine and is also very popular with the so called majority category of the Indian population.

Yes naming and shaming should be banned because if false charges are made reputation of the person is lost forever even if he is not found guilty in the Court of Law.Instead those persons especially women who feel they had been sexually harassed should go to Court and prove their charges instead of seeking publicity
