COURTS WOULD ADMIT THE CASE IF THERE IS A PRIMA FACIE CASE
by Kabeer on Oct 04, 2007 01:07 PM

Dear Ms. Shoma,
What is acceptable or not acceptable is not for you and I to judge. There is no point in pouring your wrath and frustration on these litigants. You must remember that it is not these litigants who judge or punish-they only file a complaint in the court.

It is the court that admits the case if there is a prima facie valid point. If the court decides that it is frivolus it would not admit the case; besides, if the same person repeatedly files cases that are not admissible, the court even imposes fines and penalties on these litigants.

The very fact that the courts have admitted most of the cases mean that there is at least one valid point in the petition. Remember that the Indian judiciary by far enjoys considerable reputation in the world.

By the way, if you are thinking that India is the most litigant nation you need to correct yourself; it is the US the most litigant nation in the world.

If these cases seem hurting you, consider these cases in the US.

No sooner than the Bhopal disaster occured, a huge number of US attorney firms have started signing up the supposed victims so that they can file the cases in the US against Union Carbide and extract a huge compensation and almost all of which will go as a hefty fee for themselves.

One can see helplessness and predicament of Shilpa on the Gere kissing episode when she was not just kissed but was virtually twisted 270 degrees on her back.

Shilpa wont complain as she cant be seen spoilsport
